Mid-America Pet Food is facing a class action lawsuit claiming it was negligent in the sale of its Victor pet food that was allegedly contaminated with salmonella.

A Nov. 9 announcement from the U.S. Food and Drug Administration (FDA) says it received seven reports of salmonella related to the recall. The FDA and U.S. Centers for Disease Control are investigating the cases, the pet food salmonella lawsuit says.

Six of the seven cases were in children 1 year of age or younger, and five reported exposure to dogs with three saying they fed Victor food to their pets, the Mid-America pet food salmonella lawsuit said.

The illnesses occurred between Jan. 14 and Aug. 19, 2023, the pet food lawsuit says, with one person hospitalized.

Customers accuse Mid-America Pet Food of negligence, unjust enrichment

The plaintiffs in the lawsuit accuse Mid-America Pet Food of negligence, negligent misrepresentation, breach of express and implied warranties, violation of relevant state consumer protections acts and unjust enrichment for profiting off the contaminated food.

“Due to this known risk and danger of salmonella, manufacturers should have in place or implement quality and preventive control standards and practices to prevent sourcing of and use of ingredients with salmonella in pet foods,” the Mid-America Pet Food salmonella lawsuit says.

    My 2-year old dog ate Victor hi-pro plus dry dog food and died. I have pathology reports.
