President feta cheese Greek origins class action lawsuit overview:
- Who: Michelle Gallagher filed a class action lawsuit against Lactalis American Group Inc.
- Why: Gallagher claims Lactalis American Group misrepresents that its President brand feta cheese is produced in Greece when it is actually made in the U.S.
- Where: The class action lawsuit was filed in New York federal court.
Lactalis American Group misleadingly represents that its President brand feta cheese is made in Europe — specifically Greece — when it is actually made in the U.S., a new class action lawsuit alleges.
Plaintiff Michelle Gallagher claims the President feta cheese is misleading consumers by being labeled with “Europe’s Leading Cheese Expert,” the word “feta” in Greek-style font, and a gold olive branch wreath.
Gallagher argues most or all consumers associate feta cheese with Greece and, because of that, “consumers expect that feta, labeled with representations referring to Europe and Greece, has been made in Greece.”
“Consumers are faced with increasing commercialization of products and seek brands that are genuine — feta cheese from Greece, sake from Japan, and tomatoes from Italy,” the feta cheese class action states.
Gallagher wants to represent a Florida class and multistate consumer fraud subclass of individuals who have purchased the President feta cheese product.
Consumers pay ‘premium price’ for products believed to be authentic
Gallagher argues consumers are willing to pay a premium price “for what they perceive to be authentic products, particularly those perceived to be authentically associated with a specific place.”
Consumers, however, would have to view the President feta cheese product on a third-party website in order to discover it was not made in Greece, but instead “Freshly Crafted in the USA” and “Made in the European Tradition,” according to the feta cheese class action.
Gallagher claims Lactalis American Group is guilty of unjust enrichment, negligent representation and fraud, and is in violation of the Florida Deceptive and Unfair Trade Practices Act, the Magnuson Moss Warranty Act and several state consumer fraud acts.
The plaintiff is demanding a jury trial and requesting declaratory relief along with an award of monetary, statutory, and/or punitive damages for herself and all Class Members.
In 2020, a separate complaint was filed in Canada by a Canadian First Nation arguing that wrongdoing had occurred during a deal to import 25 tons of feta cheese into the country from Greece.
