Conagra Brands’ Log Cabin pancake mix is falsely advertised as natural and a good source of fiber, a new class action lawsuit alleges.
Plaintiff Cory Henderson filed the class action lawsuit against Conagra Brands, Inc., Sept. 6 in a New York federal court, alleging violations of consumer laws.
Conagra Brands makes and sells the pancake mix under the Log Cabin brand. According to the lawsuit, the Log Cabin pancake mix is marketed as “all natural.”
“The representation that the Product is ‘All Natural’ is false and misleading because, among other reasons, it contains sodium bicarbonate, or baking soda,” the Conagra class action lawsuit states.
Sodium bicarbonate is prepared by heating a certain kind of ore until it turns to soda ash and is then combined with carbon dioxide, the lawsuit claims.
The addition of carbon dioxide is not a natural process and not one consumers would consider natural, it alleges.
Conagra class action alleges Log Cabin pancake mix makes false claims around fiber
The Conagra class action lawsuit also alleges that the product falsely claims to be a good source of fiber.
“However, the Product is not a ‘good source’ of fiber because it provides 1g of fiber per serving, or 4% of the daily value, shown on the Nutrition Facts,” the Log Cabin pancake mix lawsuit says.
As a result of the false and misleading representations, the product is sold at a premium price, the Conagra class action lawsuit states.
Henderson looks to represent a New York class of consumer who bought the pancake mix, plus a consumer fraud multistate class from New Hampshire, North Carolina, Arkansas, Utah, Iowa, Kansas, Louisiana and North Dakota.
He sues under state consumer laws, breach of warranty, fraud and unjust enrichment and seeks certification of the class action, damages, fees, costs and a jury trial.
In March, Conagra recalled cans of Rosarita Refried Beans after small rocks made their way into the beans.
