7-Eleven Wasabi Class Action Lawsuit Overview:

7-Eleven, Inc.’s Wasabi Delight Flavored Snack Mix does not contain real wasabi, a new class action lawsuit states.
Lead plaintiff Oscar Ithie lodged the class action against convenience store giant 7-11 on Nov. 14. In it, he claims the ingredients list on the product includes crunchy wasabi peanuts and wasabi green peas. However, the crunchy wasabi peanuts contain wasabi seasoning made from wasabi powder that contains maltodextrin and mustard seed—not wasabi.
Similarly, the wasabi green peas contain artificial wasabi flavor and not wasabi. By identifying the product as having a “Wasabi [Delight] Flavor[ed],” consumers will expect some of the flavor is from wasabi,” the class action lodged against 7-11 states.
7-Eleven Falsely Labels Wasabi Snack, Alleges Class Action Lawsuit
Federal and state regulations require a food labeled as “wasabi” to disclose the source of its characterizing wasabi flavor, ie, from real wasabi ingredients, extracted from wasabi and condensed into a concentrated liquid form or from natural sources other than wasabi such as horseradish or petroleum products, the lawsuit states.
“Consumers value ‘the real thing’ versus a close substitute and should be able to rely on the label to readily distinguish between the two,” according to the class action lawsuit. “This consumer protection objective is relevant to taste claims conveyed in advertising as well.”
The plaintiff seeks to represent consumers in New York, North Dakota, Rhode Island, Michigan, Virginia, North Carolina, Kansas, Wyoming, and Delaware.
Ithier seeks preliminary and permanent injunctive relief by directing the defendant to correct the challenged practices to comply with the law; injunctive relief to remove, correct, and/or refrain from the challenged practices and representations and restitution and disgorgement for members of the class; monetary damages, statutory and/or punitive damages; and costs and expenses, including reasonable fees for plaintiff’s attorneys and experts.
This isn’t the first time the convenience store giant has been accused of falsely advertising its 7-11 brand products. Earlier this month, a consumer lodged a class action lawsuit claiming 7-Eleven watermelon and lime energy shots are misleadingly marketed as “natural.”
7-Eleven is facing another class action lawsuit for falsely advertising of Juul e-cigarettes, allegedly marketing the vapes as a safer alternative to regular cigarettes.
