Rosarita refried beans lawsuit overview:

A new Rosarita refried beans lawsuit alleges that the product caused a woman’s ammonia poisoning and forced her to seek medical care.

Plaintiff Deca Thompson claims in her lawsuit against ConAgra Foods and ConAgra Brands that she suffered mouth and throat irritation along with pharyngitis and ammonia poisoning after eating Rosarita No Fat Refried Beans on March 19, 2022.

“Ms. Thompson took one bite of the burrito and felt a strong and agonizing burning pain inside of her mouth,” the Rosarita lawsuit says. “She tried to wash off that sensation with home remedies such as water, yogurt, and milk, but nothing helped.”

Thompson then went to Sky Ridge Medical Center and was diagnosed with mouth and throat irritation and acute pharyngitis, the refried beans ammonia lawsuit says. 

IEH Laboratories & Consulting Group tested the refried beans Thompson had consumed and found a high concentration of ammonia.

Thompson suffered  lacerations, blisters and bleeding inside of her mouth due to the contaminated refried beans, she claims in the Rosarita refried beans lawsuit.

Refried beans ammonia contamination left victim vulnerable to future injuries, lawsuit alleges

Thompson is now more vulnerable to future injuries as a result of the ammonia poisoning, the refried beans lawsuit claims.

“As a direct and reasonably foreseeable result of the product, Ms. Thompson suffered and will continue to suffer past and future economic damages, past and future non-economic damages, and damages for physical impairment and disfigurement,” the Rosarita lawsuit claims.

ConAgra is accused of negligence, breach of implied warranty of merchantability and violation of strict product liability. 

Thompson says she had to pay medical costs at the time of her injury and expects more medical expenses in the future as a result of her ammonia poisoning. She is asking for economic damages, wage loss, non-economic damages and damages for physical impairment and disfigurement, as well as all interest, costs and attorney’s fees.

ConAgra recalled some lots of its Rosarita Traditional Refried Beans Organic in March 2022, saying that small rocks could have made their way into the product.
