7-Eleven, Juul Class Action Lawsuit Overview:

7-Eleven has been hit with a class action lawsuit for alleged false advertising and marketing of Juul e-cigarettes, allegedly asserting Juul products are a safer alternative to regular cigarettes, when in fact they are not.

The lawsuit was filed in Florida on Oct. 13 by lead plaintiff Cristian Ali, who alleges that 7-Eleven’s false and misleading representations and omissions violate state and federal law, including Florida’s Deceptive and Unfair Trade Practices Act.

He argues that despite the fact that a single Juul e-cigarette delivers the same amount of nicotine as an entire pack of traditional cigarettes, and that Juul’s highly concentrated nicotine delivery system causes users to easily become addicted to the harmful e-cigarettes, 7-Eleven provides no warning of the potency and potential for addiction.

As a result of 7-Eleven’s alleged false and deceptive marketing, which included product placement and postings online and in-store, Ali says he bought Juul e-cigarettes “that are unreasonably harmful and addictive.”

The plaintiff says he was unaware that the nicotine content in Juul pods is much higher than in cigarettes as well as most other e-cigarettes, partially because they contain protonated nicotine, which allows users to absorb higher concentrations than they would from products made with free-base nicotine.

In the lawsuit, Ali says protonated nicotine is less harsh and thus easier to handle for those who were not previously smokers, contributing to the e-cigarettes’ addictiveness.

“The discreet appearance of the Products and lack of smoke also make them appeal to younger generations and people who previously had no interest in smoking or seek safer alternatives to cigarettes,” he argues in his complaint.

7-Eleven Ignored Legal Action Against Juul and Continued to Sell Highly Addictive Product Without Proper Warnings, New Class Action Lawsuit Claims

7-Eleven was aware of the scale of legal actions against Juul and of the Food and Drug Administration warnings against the products, along with the numerous discoveries of illnesses associated with e-cigarettes, but continued to omit that information from its marketing of Juul e-cigarettes, the plaintiff claims.

“Despite Defendant’s actual knowledge of the extremely high nicotine content and wealth of information elucidating the inordinate hazards of the products, defendant failed to warn that the products it markets and sells are far more potent and addictive than tobacco cigarettes,” the lawsuit alleges. “In fact, prior to 2018, the defendant failed to warn that the products contained any nicotine at all.”

Ali is suing on behalf of anyone in Florida who bought a Juul e-cigarette at 7-Eleven. He is suing for violation of state trade laws, breach of warranty, and unjust enrichment. He seeks certification of the Class, order of enjoinment, injunctive relief, damages, disgorgement, interest, legal fees and costs, and a jury trial.

Juul is currently facing a host of lawsuits over its e-cigarettes, including an MDL in California. This week Juul Labs Inc., Altria Group Inc., and their executives filed several motions to dismiss the Saint Regis Mohawk Tribe and the Grand Traverse Band of Ottawa and Chippewa Indians from the multidistrict litigation, arguing the two Native American tribes have no legal basis for their claims.

The two tribes are part of a larger MDL that involves hundreds of plaintiffs across school districts and municipal governments. The multiple class action lawsuits accuse Juul and its part owner, Altria, of contributing to a youth vaping epidemic

    I’ve been smoking for years and I smoke different Vapes as well but after I use the jewel Vape I developed an ulcer on my esophagus and the doctor told me there is absolutely no other reason why that ulcer is there I’m getting treatment now add me to your list
