Tesla door handles class action lawsuit overview: 

  • Who: John L. Urban filed a class action lawsuit against Tesla Inc. d/b/a Tesla Motors Inc.
  • Why: Urban claims Tesla Motors sold 2014-2016 Model S vehicles containing defective door handles that created a safety risk. 
  • Where: The class action lawsuit was filed in California federal court. 

Tesla Motors manufactured and sold model year 2014-2016 Model S vehicles containing defective door handles that “routinely fail” within a few years under normal use, a new class action lawsuit alleges. 

Plaintiff John L. Urban claims the alleged defect with the Tesla vehicles prevents drivers and passengers from being able to exit the vehicle, creating a “significant safety risk” in the event of an emergency. 

Urban argues Tesla knew or should have known about the defect when testing the vehicles prior to their release, “especially as the Vehicle provides no alternative method to open an affected door from the outside when the Defect manifests.”

Tesla also failed to disclose the alleged defect to consumers, despite the automaker having a “duty to do so,” the Tesla class action alleges. 

Urban wants to represent a nationwide class of consumers who are owners or lessees of a Tesla model year 2014-2016 Model S vehicle purchased or leased within the U.S. 

Tesla is accused of breach of implied warranty of merchantability and breach of express warranty under California law, and of violating California’s Unfair Competition Law and  Consumers Legal Remedies Act

Plaintiff is demanding a jury trial and requesting injunctive relief along with an award of actual, compensatory, and statutory damages for himself and all class members. 

Tesla announced it was recalling almost 1.1 million of its vehicles in September after discovering their power window automatic reversal systems may not properly react in the event of an obstruction, creating a pinch risk
