Product Liability Class Action Lawsuit Overview:

  • Who: Some product manufacturers are facing product liability class action lawsuits in 2022.
  • Why: Consumers allege the product manufacturers sell products that put consumers at risk of serious health issues, including cancer.
  • Where: Product liability lawsuits have been filed in various courts throughout the United States.

Top Class Actions has been following dozens of product liability cases that have the potential to bring significant compensation to those affected. Here are 10 of the top cases we are watching in 2022.

Roundup Cancer Multidistrict Litigation

Mansanto’s popular weed killer Roundup is the target of multiple lawsuits filed by farm workers, landscapers and home gardeners who claim they developed non-Hodgkin’s lymphoma or other types of cancer after using Roundup. Glyphosate, the active ingredient in Roundup, has been linked to cancer.

Monsanto has already been ordered to pay significant compensation to plaintiffs who claim they developed Roundup cancer, including a $289 million award to a former school groundskeeper in California.

Benzene in Aerosol Products

Several spray deodorants and antiperspirants contain the toxin benzene, according to the independent lab Valisure. Valisure also discovered the presence of benzene in several popular sunscreen products. 

As a result, the Procter & Gamble Company is recalling 32 different products of dry shampoo and conditioner from brands Pantene, Aussie, Herbal Essences, Waterl<ss, Hair Food and Old Spice due to the presence of the cancer-causing chemical benzene. 

Antiperspirant manufacturer Secret is also recalling 10 of its aerosol spray antiperspirants due to the presence of benzene detected in some products.

Those who purchased spray deodorants and antiperspirants may be eligible to join a free toxins in spray deodorant lawsuit investigation.

Baby Formula Side Effects

Newborns who are born prematurely are often given baby formula to supplement their diet. However, some cow’s milk-based Similac and Enfamil baby formula products have allegedly been linked to a disease called necrotizing enterocolitis, or NEC, which can be fatal to infants.

Parents who fed their premature babies Similac or Enfamil baby formula only to have their child diagnosed with NEC complications may qualify to join a baby formula class action lawsuit investigation.

Baby Powder Cancer

Johnson & Johnson is facing multiple baby powder cancer lawsuits by women and their families who allege daily use of the product caused them to develop ovarian cancer. Many plaintiffs have been awarded significant compensation for their injuries. 

Recently, the Missouri Supreme Court upheld a $2.12 billion verdict against J&J after nearly two dozen plaintiffs alleged asbestos-tainted baby powder caused them to develop ovarian cancer.

Toxic Metals in Baby Food

Baby food makers have also come under scrutiny for allegedly selling baby food that is tainted with toxic metals such as arsenic, lead, cadmium,and mercury. Metal contamination has reportedly been linked to neurological disorders and autism. Parents of children who developed these conditions after consuming certain baby foods may have a legal claim.

Several baby food makers are currently facing class action lawsuits alleging they failed to disclose that their products contain toxic heavy metals. Recently, a California federal judge ruled that Plum Organics must face a baby food heavy metals class action lawsuit. 

Zantac Cancer Lawsuits

In 2020, the U.S. Food and Drug Administration asked for the immediate withdrawal of ranitidine products, including the heartburn medication Zantac, due to contamination with the potentially carcinogenic NDMA. 

More than 130,000 plaintiffs have reportedly filed personal injury lawsuits after they allegedly developed cancer. Those Zantac lawsuits have been consolidated in multidistrict litigation in Florida federal court. Bellwether trials in the Zantac cancer MDL may begin in 2023.

JUUL Heart and Lung Side Effects

E-cigarettes such as JUUL were touted as a healthier alternative to smoking tobacco cigarettes, but an increasing number of e-cig users have allegedly suffered from serious heart and lung injuries. Now the JUUL makers are facing a growing number of lawsuits alleging they aggressively marketed e-cigs to youth.

Recently, a California federal judge dismissed personal injury claims against JUUL executives, finding that they were not the appropriate defendants for those specific claims. Those claims were filed as part of multidistrict litigation challenging JUUL’s marketing, sales practices and products liability.

Firefighting Foam Cancer

Firefighters already face significant danger due to the nature of their jobs, but the firefighting foam that they use to suppress fires may actually cause them to develop cancer

Firefighting foam manufacturers are currently facing class action lawsuits alleging they put firefighters at risk by knowingly selling firefighting foam that contains harmful synthetic chemicals.

CPAP Machine Recall

In June 2021, millions of Philips CPAP, BiPAP and ventilator machines were recalled due potential health risks, including a potential risk of cancer. The Philips CPAP machine recall notice warned consumers that the sound muffling foam in the products could degrade into tiny inhalable particles that could cause adverse health effects, including a potential cancer risk.

Following the Philips CPAP recall announcement, dozens of consumers filed CPAP recall class action lawsuits alleging Philips knowingly exposed them to dangerous toxins.

SoClean CPAP Cleaner

Class action lawsuits have also been filed against the maker of the SoClean CPAP cleaner for allegedly failing to disclose that the devices can generate ozone, an unstable and toxic gas. If you experienced asthma attacks, chest pain, difficulty breathing or other respiratory issues after using a CPAP machine that was sanitized with a SoClean CPAP cleaner, you may qualify to take legal action against the product maker.
