Update:

  • A federal judge in Florida ruled that tens of thousands of consumers who are part of multi-plaintiff cases against Zantac manufacturers must now file their claims separately after a court found no evidence that Zantac’s active ingredient causes cancer. 
  • The court initially put the motions filed on behalf of the approximately 58,000 Zantac claimants in a now-abandoned registry that allowed claimants to suspend the statute of limitations on their claims. 
  • However, the court abandoned the registry after it dismissed claims against Zantac manufacturers Pfizer, GlaxoSmithKline, Boehringer Ingelheim and Sanofi in December.
  • The judge ruled the individuals who were part of the registry must now file their claims separately in a federal court for them to be timely.

Plaintiffs involved in multi district litigation over alleged links between Zantac and various types of cancer are being considered for a future bellwether trial regarding the heartburn drug. 

A pool of more than 130,000 personal injury claimants are being considered as potential plaintiffs for the trial targeted to begin sometime in 2023, reports Law360.

Major pharmaceutical brands including Sanofi, Pfizer Inc., Boehringer Ingelheim Pharmaceuticals Inc., and GlaxoSmithKline LLC are facing allegations of failure to warn and false advertising, among other things. 

The allegations are related to the alleged discovery that Zantac contains a cancer-causing chemical called nitrosodimethylamine (NDMA). 

Drug manufacturers previously attempted to escape charges from a medical monitoring Class, however, a court ruled earlier this month that they could face damages from plaintiffs who were not diagnosed with cancer but are seeking damages for the potential medical care they may need down the line. 

The court has decided to limit the plaintiffs for the bellwether trial to those that reside in Florida, in order to keep from the court having to sign out-of-state waivers or have their subpoena powers challenged, reports Law360.

The 130,000 personal injury claimants being considered for the bellwether trial have been diagnosed with a combined 10 different types of cancer that they blame on their Zantac usage. 

Of the claimants who certify their complaints within the MDL, 6 percent will be randomly chosen in each cancer category to form the plaintiff “initial discovery pool,” reports Law360. If there are not  25 claimants picked for a category, 25 percent of claimants from within each category will be randomly chosen. 

Once a “final discovery pool” has been set the court will decide what cancer claims will be allowed to proceed. The expectation is for that ruling to happen in either the fall or summer of next year.

      Ive gone thru hell. Pancreatic Cancer after taking ZANTAC for just 4 yrs. 1st by prescription then OTC. They removed ½ my pancreas, my gallbladder, ½ my stomach & i spent 4 ½ months in hospital bed. 2 critical, 2 recovering with 300 staples across my abdomen. I weighed 274, 6ft 2 tall before Zantac.. im 169 & still losing weight. 40 waist to 28 as i have to take CREON so my food will digest as losing HALF pancreas your body can’t digest. Also diabetic now, lifestyle change as being 59 never diabetic until losing ½ pancreas. Im really upset with this judge. I went with Morgan & Morgan & they never even call me, im barely alive at this point & cant get no one to help me. I have half full bottles of ZANTAC & empties, receipts all proof.. no gives a rats ∆SS

    My father died of bladder cancer after taking Zantac as well. My case was part of the MDL in Florida, after it was dismissed I filed a new case in Michigan where I have to act as my own attorney. I just cannot let the manufactures of Zantac get off scot free.

    As a Registered Nurse, and a Respiratory Therapist, I have no doubt that my exposure to the known carcinogen NDMA facilitated my cancer diagnosis. I am the 5th of 7 children in my family growing up in a family of 9. At the age of 1 had chronic symptoms of what we now call gastric esophageal reflux disease (GERD). My family physician Dr. Paul Wayne Brown prescribed me Zantac. I was a non-smoker, non-drinker and had no known family history of cancer. I had the same environmental exposure as the other 8 people in my home, yet I alone got cancer. I was the ONLY one taking Zantac. My cancer is called Rhabdomyosarcoma a soft tissue cancer very rare and usually lethal at the time and found in pediatric populations. I suffered a left orchiectomy and a YEAR long chemotherapy regimen of Vincristine and Dactinomycin. Those chemo agents exacerbated and accelerated my atherosclerosis and arthritis. I have Barret’s esophagus and other inflammation induced disease processes secondary to the damage by chemotherapy necessary due to Zantac. Not only is NDMA exponentially higher than the 90 nanograms a day the FDA says is “allowable”. The scientists who knew the drug best voiced their concerns about the toxicity/carcinogenicity of Zantac . They were silenced and the company covered it up for 40 years. Because my tumor was testicular (in situ) lay lawyers without a medical education don’t realize that it is a muscular cancer in its etiology, comparable to uterine, esophageal, colon, bladder, and stomach and others. These organs are ALL smooth muscle, the same cytology as rhabdomyosarcoma. If you know any man that has had testicular ca in situ, and took Zantac, make sure he doesn’t take no for an answer. I won’t.
