A new class action lawsuit claims Kohler manufactures and sells bidet toilet seats with a known design flaw that causes them to leak water.
Plaintiff Annalaise Baird filed the lawsuit on Oct. 5 in California federal court, alleging violations of state and consumer laws.
According to the class action lawsuit, โKohler manufactured and sold the M250 bidet toilet seat with a known design flaw that causes leaking at the control handle, thereby rendering it useless.โ
Baird claims the defect is due to a flaw in the plastic handle and other mechanisms, which results in water leakage and potential water damage.
She wants to represent anyone in the United States who purchased a Kohler PureWash M250 Bidet Toilet Seat.
Kohler allegedly knew about defect from customer complaints, internal test data
Baird claims Kohler was made aware of the defect through customer complaints, online user reports, internal testing data and repeated failures in replacement devices. Despite this knowledge, Kohler continued to sell the bidet toilet seats without disclosing the issue to consumers, the class action lawsuit says.
The plaintiff alleges she purchased the Kohler bidet toilet seat from Amazon for $79.99, expecting it to last several years. However, she says she discovered the defect when the control handle began to leak water onto her bathroom floor, making the PureWash M250 Bidet Toilet Seat unsuitable for its intended purpose.
Baird claims she attempted to make a warranty claim but was informed she was outside of the warranty period. The plaintiff argues she would not have purchased the Kohler bidet toilet seat, or would have paid significantly less for it, had she known about the defect.
The Kohler class action lawsuit is suing for violations of Californiaโs Consumers Legal Remedies Act, Unfair Competition Law and False Advertising Law as well as breach of implied warranty, fraudulent concealment, negligence and unjust enrichment.
Baird is seeking an order certifying the class action, compensatory and statutory damages and an order enjoining Kohler from further deceptive distribution and sales practices with respect to the bidet toilet seats.
Meanwhile, a consumer is suing Kohler for alleged privacy violations, claiming that even after visitors to the websites kohler.com, robern.com and kallista.com click โReject Allโ to cookies, Kohler still allows third-party tracking cookies to monitor browser activity.
