Stiiizy class action overview:

  • Who: Plaintiffs Taylor Byron and Taylor Berry filed a class action lawsuit against Stiiizy Inc.
  • Why: Stiiizy sells cannabis products labeled as legal Delta 8 hemp that have 200% of the legally allowed amount of THC, the lawsuit claims.
  • Where: The Stiiizy class action was filed in federal court in East St. Louis, Illinois.

Two customers filed a class action lawsuit against Stiiizy Delta 8 hemp for selling products with 200% of the legally allowed THC.

Delta 8 products can be sold in Illinois or Missouri with up to 0.3% active THC without following the same regulations that cannabis sellers have to follow. This leaves retailers, sellers and distributors to be honest and accurate about the ingredients and side effects of the products, the lawsuit says.

Despite being marketed as a Delta 8 product, the Stiiizy Skywalker OG Pen D8  was shown in lab testing to contain 3.57% of Delta-9 THC, the Stiiizy cannabis lawsuit says — an amount that should require the product to follow heightened regulations.

“Stiiizy D8 Products lack any of the protections afforded consumers as a result of the licensing, testing, labeling, warning and advertising restrictions applicable to cannabis products, meaning consumers are being placed at increased health, safety and medical risk by Stiiizy D8 Products that are, in fact, a controlled substance,” the lawsuit says.

Stiiizy class action: Company intentionally misleads customers on THC products

The United States industrial hemp market is estimated to be worth between $1 billion and $2.21 billion and growing, the Stiiizy Delta 8 lawsuit says.

Stiiizy has misbranded and misled customers with products that don’t legally fit the description of that market, instead selling Stiiizy cannabis that should be regulated as a controlled substance, the lawsuit claims.

“As one of the nation’s largest cannabis product manufacturers, Stiiizy is well-aware of the THC requirements for all types of products, including Delta 8, CBD, and traditional cannabis, yet is willfully disobeying those requirements for its own profit and to the detriment of consumers,” the Stiiizy class action says.

In another cannabis-related lawsuit, Curaleaf agreed to a $100,000 class action lawsuit settlement to resolve claims that its CBD drops contained THC despite being advertised as containing only CBD.

  1. Richard, HIGLE says:

add hey, add me to this I’m in California. This has been a huge problem. Being told this is cannabis free and getting pulled over with it and they prove. In court that it’s THC, and were the ones that get a DUI for it like we get accused by the legal system of making it ourselves or knowingly having it when we thought we were doing everything by the book
