Vizzy mimosa hard seltzer class action lawsuit overview:

  • Why: Krechting and Fahey claim Molson Coors misrepresents that its Vizzy Mimosa Hard Seltzer beverages are based on sparkling wine.

A new class action lawsuit claims that Molson Coors misleadingly represents that its Vizzy Mimosa Hard Seltzer beverages are sparkling wine.

Plaintiffs Kate Krechting and Andrea Fahey’s class action lawsuit claims Vizzy Mimosa Hard Seltzer is not based on sparkling wine, as a mimosa would be, but rather on fermented sugar, which qualifies the product as a beer.

Krechting and Farhey argue that, despite this, Vizzy Mimosa Hard Seltzer beverages are sold in orange packaging with pictures of oranges and the statement “Made With Real Orange Juice” to make consumers believe the product is based on a sparkling wine mimosa.

“The labeling of ‘Mimosa Hard Seltzer’ … tells consumers they are buying a canned version of a mimosa, defined by the presence of sparkling wine and orange juice,” the Vizzy mimosa class action claims.

Krechting and Farhey want to represent a Florida class of consumers who purchased the Vizzy Mimosa Hard Seltzer as it is identified in the class action lawsuit.

Krechting and Farhey’s class action lawsuit claims the only disclosure that the Vizzy Mimosa Hard Seltzer beverages are beer comes in fine print on the reverse side of the cans, meaning a consumer would have to first buy and open a case.

“Even if consumers looked at the bottom of the package prior to buying it, they would not see it identified as a ‘beer’ anywhere in the fine print,” the Vizzy Mimosa class action states.

Krechting and Farhey claim Molson Coors is guilty of Florida’s False and Misleading Advertising statute and the Florida Deceptive and Unfair Trade Practices Act. The plaintiffs demand a jury trial and request declaratory relief and monetary damages for themselves and all class members.

A consumer filed a similar class action against Molson Coors in October 2023 over claims the company falsely advertised the ingredients of Vizzy Mimosa Hard Seltzer beverages.
