Wyndham in Las Vegas - Wyndham timeshare

Wyndham timeshare owners have filed a class action lawsuit against the company, accusing it of lying to customers about benefits and subjecting them to aggressive marketing tactics to get them to purchase useless points.

In the most recent Wyndham Vacation Resorts class action lawsuit, timeshare owners David and Thea DuBose say the company defrauds customers both before they sign on to a timeshare and after they have already purchased one.

They claim the company touts that the timeshares are offered at attractively low prices and destinations around the world will be available to timeshare owners. However, the customers say that in reality, it is almost impossible to book a stay at one of Wyndham’s destinations, and it would be cheaper to pay cash for a vacation.

The DuBoses are Georgia residents who say they made their purchase of a Wyndham timeshare on June 23, 2016, in Florida.

They say that while they were on vacation in Panama City, Florida, a Wyndham representative offered them a gift card and encouraged them to attend a timeshare sales presentation.

They explain that they were told the meeting would last only 90 minutes, but instead, the meeting lasted almost all day.

Additionally, a Wyndham sales representative was supposedly assigned to sit with them “on a one-on-one basis” throughout their time at the resort.

Allegedly, the company made a range of fraudulent sales pitches, telling the couple they would “never have to pay for another vacation for the rest fo their lives,” and would save tens of thousands of dollars.

They say the representatives told them they would have access to resorts around the world, particularly at the new Rio Mar, Puerto Rico, resort.

The couple goes on to say they were told they would be able to leave their timeshare to their children.

They were also supposedly told they could resell their points or could make money from the points by renting them.

However, the DuBoses say the offers were misleading for a range of reasons.

They state that points expire annually if they go unused, and timeshare owners are charged maintenance fees that increase regularly. Also, significantly, using their Wyndham points is more expensive than booking a vacation through another, non-Wyndham company.

They also state that frequently, many destinations are not available to timeshare owners because most of the resort space is not given to timeshare owners to use.

The Wyndham timeshare false advertising class action lawsuit says these misrepresentations are the same ones fed to many other customers during the timeshare purchasing processes, even after they purchase.

The DuBoses cite complaints made by other customers, including customers who say they were subjected to extensive pushy sales tactics after they purchased their timeshares.

Allegedly, when they visited resort locations, the customers were required to attend “Owner Update” meeting to access certain amenities. They were allegedly told these meetings would last only 90 minutes, when they really lasted all day.

The Wyndham timeshare owners say that instead of mere updates, these meetings were an effort to get timeshare owners to shell out more money for more points or to access various amenities.

Customers say they felt cornered into buying more points and spending more money because the company made concerted efforts to prevent them from leaving the meetings, and made sure the customers had spent a certain amount of time at the meetings to receive benefits.

Previously, the DuBoses filed a class action lawsuit against Wyndham over these claims in Illinois, but it was dismissed because the court determined that the couple lacked jurisdiction in Illinois.

Now, the couple has filed in Delaware and assert that their claims are timely, per the terms of their contract with the company.

This is not the first time Wyndham has faced claims that the company misleads and takes advantage of customers.

In February, customers filed another Wyndham class action lawsuit similar to the DuBoses’.

    Same thing happened to us. Convincing us that we needed to be VIP to be able to book things easier. We upgraded and thought our payment was in full just like our initial purchase. Come to find out it was just a down payment. Wish we never got involved with Wyndom. We would gladly join any class action lawsuit against their deceptive practices.

    My wife and I have purchased multiple times from SVC, got pulled into Wyndham and now they are making it near impossible to pay the ever-rising maintenance fees then sending us to collections when THEY don’t apply the submitted funds properly. The moment our account is late (which happens too often because they don’t send statements and the balance due is ALWAYS different), they lock the website needed to make payments then harass me with SMS messages having links that cannot be used to make payment. To say we were defrauded into this deal is an understatement. I wish SO much that they would just buy back our initial investment and be done with them.

    I cancelled and got refund with professional help from attorneys at H4X Credit Solutions. These guys know them well and exactly what makes them tickle . I got my check for private settlement within 10 days on involving H4X .

    We said no over and over and they would send the high pressure guy back who would get in my face shaking his head yes! We caved only to find out that what we purchased was worthless. Covid hit and we were financially destroyed. Whyndham now has a law firm garnishing my husband’s check 25 percent a week as of last week! We are destroyed at 60 and 65 yrs old. My husband needs knee replacement and we can barely pay Medicare payments. Is there help???

    i want to keep my timeshare but have them payoff the
    ‘down-payment” to the cc they signed me up for but didnt realize i was signing up for. in october of 2021 i decided to become an owner after using their “discovery” plan. for 1600 i bought 250k points. after having incredible vacations i knew i couldnt go back. after signing up for the discovery plan i was told that the money i used that day would then be applied as my down payment if i decided to become an owner. well i thought ride this plan out and let go and the following year try to do it again lol. well like i said i was in orlando and was doing my last discovery stay and didnt want it to end. so i went to the meeting and i point blank told the girl that i want to be a member and this is what i can afford and use my discovery as down payment. she said that the amoount i could afford in points will never get me to 250, instead i got to 126 with some bonus signing points. little did i understand that this included a 5000 downpayment and they were on the phone with a “partner” to get me approved out of pocket. usually that means not borrowed. they got me into a cc that was above my limit and a horrible bank, Comenity Bank. i got a bill for 250 a month to pay back?? my monthly finance on the 126 is 256 and the maintnance fee is 100. from some stories i got off easy but the bad credit now. i refuse to pay that card and i need it paid off asap. wyndham destroyed my credit. i want the debt paid and i want to have a free membership. i actually still like the properties lol is that wrong?? lol

    i have all the same issues and then some. The recurring monthly maintenance fee used to cover the housekeeping when I have stayed-doesn’t. they said we did not purchase enough points towards that so had to pay more. and that was for a “free” week they talk of-again a scam. My recurring fee gets charged every month and the cost has went up without notice and now we are receiving collection call for over 200 and I have no idea what it could be for, Soooo mad at this ordeal. We paid off the points about 5 years ago and have been paying on the maintenance fee since then and cant get anything booked for last five years. Im so mad at this and cannot believe that they aren’t being held accountable

    When we were about to walk away from their presentation, they offered us what they called a repo. They said we would receive 230,000 points annually. After we made the purchase and received documents in the mail we found out the points were bi-annual rather than annual. Numerous calls and emails got us nowhere. Each time we’re forced to attend a presentation, I tell them the issue I have they want me to fix the problem by purchasing more points. It makes no sense. You lied to me to get me to purchase the first time and want me to spend more money to fix your lie. On top of that, using the points where we want is always difficult. There is rarely space available, which is another lie. My last trip to Arizona, it took me more than two weeks of trying to get a reservation before I space became available. I thought the resort would be booked solid. For our entire stay the resort was basically empty. Never more than ten cars in the entire parking lot, and only saw a few people. During the presentation at this resort the present or said your level of purchase determines how many rooms are released and available to you. So the more points you purchase, the more accessible the resorts are. In other words, give us more of your money. When I refused, as usual, they became very short and borderline rude.

    I would happily join any class action suit filed against this company.

    I also need to get out of this. It is ridiculously high in payments, and the salesman made everything sound like I could be able to easily rent out my timeshare to make up for the high payments and he would be there to help me anytime I needed it to make sure Things went well but I never heard from him again. I’ve had this timeshare for 20 years and I still somehow owe $92,000 Worldmark by Windham.

    So they told me it would take only about 90 mins when I did my Wyndham timeshare to but it took all day me and the family lost a day of are vacation because of the timeshare that will be 8 hours of my time I will never get back we have had it going on a year and never have used it is crazy by the the time I make my monthly payments can’t afford to even make plans anymore
