Update:

  • American Airlines and Kiwi reached a settlement in American’s lawsuit claiming Kiwi continues to sell unauthorized tickets.
  • The American Airlines settlement filing did not disclose details of the deal but asked for the Kiwi lawsuit to be dismissed with prejudice and stipulated each party would pay its own attorney fees and costs.
  • U.S. District Judge Mark Pittman previously denied Kiwi’s attempt to dismiss the claims, stating Kiwi was within the district’s jurisdiction because it sold tickets to Texas customers.

American Airlines Inc. filed a lawsuit against Kiwi Inc. and Kiwi.com for the unauthorized sale of American Airlines tickets.

Kiwi was an American Airlines agent with the authority to sell American tickets between 2018 and 2020 but American discontinued that agreement after it says Kiwi violated the agreement terms.

“Kiwi repeatedly violated the agreed terms of its agency agreement through similar abusive ticketing practices, and American terminated Kiwi’s authority to issue tickets on American’s behalf,” the Kiwi lawsuit says. “Since then, completely lacking authority but undeterred, Kiwi has continued, on an ongoing basis up through the present, to hold itself out as an American agent, to sell tickets for American flights, attempting to bind American to contracts of carriage even though Kiwi has no authority to do so.”

Kiwi used its own credit card info, other third-party vendors to sell tickets, lawsuit alleges

Kiwi has used two methods to gain access to American Airlines tickets and flights, substituting its own credit card information and fake email addresses and also buying tickets through authorized third-party agents, the American Airlines lawsuit claims.

American Airlines is seeking an injunction against Kiwi along with a full list of sales of American Airlines flights since the agreement ended in 2020 and damages along with interest and attorney’s fees, the American Airlines lawsuit states.

JetBlue recently announced it would drop its Northeast Alliance (NEA) partnership plans with American Airlines after a federal judge ruled against the NEA and it will instead pursue a merger with Spirit Airlines.

    Kiwi is a third party company that bases their policies on confusing and misleading information. They also book flights with airlines that no longer operate, so they take your money by stating it was not their fault. I was not able to request to speak to a manager directly, so they said they would decide when to call me back, supposedly to speak with Kyritika Dongle, one of their managers. In a nutshell this company does not take responsibility for flights cancelled by airlines nor they are willing to help you navigate other alternatives. No only my flight was canceled, they refused to provide me with an alternative option unless I paid more it myself and there was no refund.

    I was apart of these and when my fight get cancel and I tried to use my trip protection i found it (I) wasn’t authorized beacuase of how i brought my ticket

    I purchased tickets for myself and my children through Kiwi for an Allegiant flight. They book all of us on separate itineraries and changed the birth dates of my children (I have confirmation I correctly provided this information). We were unable to board the flight, have not received a refund, and had to spend more time and money to get home. I was told this happens regularly with Kiwi. Isn’t this fraud and doesn’t it represent a security risk?
