Vail Resorts Labor Laws Class Action Lawsuit Overview:

  • Why: The plaintiffs allege that Vail Resorts failed to pay them for hours worked.
  • Who: Current and former employees are suing Vail Resorts.
  • Where: The class action lawsuit is pending in Colorado federal court.

Current and former Vail Resorts employees are suing the employer for violating federal and several state labor laws by failing to rightfully compensate employees for hours worked, overtime, training, and equipment reimbursement. 

The lead plaintiffs are Randy Dean Quint, John Linn, and Mark Molina, who work or worked at Beaver Creek Resort. Quint says that between December 2017 and December 2019, Vail shortchanged him by $8,363.30 for more than 470 additional hours worked. Linn claims he was not paid for 213 hours worked from December 2017 through March 2020, in addition to 130 hours of overtime. 

The complaint involves 13 other current and former employees as “opt-in plaintiffs” and seeks to represent a proposed Class of current and former employees who worked for Vail Resorts over the past three years and faced similar compensation issues.

The class action lawsuit alleges misconduct in Colorado, California, Utah, Minnesota, Wisconsin, Washington, New York, Vermont, and Michigan, where the company has resorts. 

Vail Resorts Fails to Account for All Hours Worked, Class Action Claims

The class action lawsuit takes issue with the discrepancies and unfairness in Vail Resorts’ policies and compensation. 

Quint and Linn allege that Vail instructors are supposed to log 6.5 hours for a full-day private lesson per company policy, although in reality, their workdays last nine to 10 hours. The allowed 6.5 hours are supposed to last from 9 a.m. to 3:30 p.m. and includes lunch and completion of time cards. However, employees also had to attend team meetings at 8:45 a.m., which falls outside of billable hours, according to the complaint. 

The plaintiffs also complain of not being paid for “off-the-clock” work, such as traveling from resort parking lots to worksites and the time required to put on and take off snow gear, which adds up quickly especially when unpaid.

The complaint accuses Vail Resorts of unjust enrichment, or illegally making money at the expense of others. In this case, the class action claims Vail Resorts illegally made millions of dollars by “willfully and systematically” underpaying its employees. 

Last year, a skier lodged a class action lawsuit alleging Vail Resorts charged him and others “unconscionable” fees in the midst of the COVID-19 pandemic.
