NFL class action lawsuit overview: 

  • Who: Melissa Chrum filed a class action lawsuit against NFL Enterprises LLC. 
  • Why: Chrum claims the NFL sent unsolicited text messages to individuals who already opted out of receiving them and to numbers listed on the National Do Not Call Registry.

NFL Enterprises engages in unsolicited text messaging and continues to send consumers NFL texts even after they have opted out of receiving the solicitations, a new class action lawsuit alleges.

Plaintiff Melissa Chrum’s class action lawsuit claims the NFL’s alleged text messages have resulted in an invasion of privacy and disruption of daily life for thousands of individuals and constitute harassment and aggravation. 

Chrum argues in the NFL class action that she received text message solicitation from the NFL multiple times after she first asked it to stop contacting her on Sept. 17, 2023, more than a month after she says her number was also first listed on the National Do Not Call Registry. 

“Defendant continued to send (Chrum) text messages on September 17, 24, 2023 and October 7, 15, 2023 and November 5, 10, 12-13, 2023,” the NFL class action states. 

NFL texts violated TCPA, class action claims

Chrum wants to represent a nationwide class of individuals who, within the last four years, were sent a text message from the NFL or anyone on its behalf after having requested the NFL not to contact them again. 

The plaintiff also wants to represent a nationwide class of individuals who were contacted by the NFL more than once during any 12-month period at a number listed on the National Do Not Call Registry, with several stipulations. 

Chrum claims the NFL texts violated the Telephone Consumer Protection Act. She is demanding a jury trial and requesting declaratory and injunctive relief and an award of statutory damages for herself and all class members. 

A consumer filed a separate class action lawsuit against the NFL — along with Fanatics LLC — in late December over claims the league and its franchises colluded with Fanatics to increase the price of NFL-licensed merchandise and “dominate” the online market.
