Shopify, Ledger Crypto Wallets Data Breach Class Action Lawsuit Overview:
- Who: Gregory Forsberg, Christopher Gunter, Samuel Kissinger and Scott Sipprell filed a class action lawsuit against Shopify and its vendor TaskUs.
- Why: The group of Shopify buyers claim the company failed to keep its private information from falling into the hands of hackers during a 2020 data breach of Ledger SAS, which sells cryptocurrency hardware wallets they purchased.
- Where: The class action lawsuit was filed in Delaware federal court.
Shopify and its vendor TaskUs failed to secure and safeguard consumer information during a 2020 data breach of Ledger SAS cryptocurrency hardware wallets, a new class action lawsuit alleges.
Plaintiffs Gregory Forsberg, Christopher Gunter, Samuel Kissinger and Scott Sipprell claim around 272,000 Ledger cryptocurrency hardware wallet owners, and Shopify buyers, like themselves had their full names, email addresses, phone numbers and postal addresses exposed in the breach.
Shopify’s platform hosts Ledger’s website where it sells its cryptocurrency hardware wallets, according to the class action lawsuit.
The Shopify buyers claim Ledger has built and marketed its platform on having the “utmost security and trust to its customers,” and that it, along with Shopify, knows how important it is to protect cryptocurrency holders’ personal information.
“Ledger and Shopify know that cryptocurrency transactions are publicly visible through a transaction’s underlying blockchain, but cannot be traced back to their particular owner without more information,” the class action lawsuit states.
Shopify In Possession Of ‘Extremely Valuable’ Customer List, Plaintiffs Say
Forsberg, Gunter, Kissininger and Sipprell claim cryptocurrency owners are in danger of being victimized if their personal information falls into the hands of hackers, and say that Ledger’s customer list, which Shopify was allegedly in possession of at the time of the breach, is “extremely valuable.”
“One instance of a customer mistakenly releasing their account information to hackers can lead to the loss of millions of dollars in cryptocurrency that will never be returned to their owner,” the class action lawsuit states.
Forsberg, Gunter, Kissinger and Sipprell claim Shopify and TaskUs are guilty of negligence, negligence per se and unjust enrichment and in violation of Florida’s Deceptive and Unfair Trade Practices Act, the North Carolina Unfair and Deceptive Trade Practices Act, the Arizona Consumer Fraud Act and the Kentucky Consumer Protection Act.
Forsberg, Gunter, Kissinger and Sipprell want to represent a nationwide class and Arizona, Kentucky, North Carolina and Florida subclasses of consumers who provided Shopify and TaskUs with personal information that was exposed during the data breach.
A similar class action lawsuit was filed last month against Accutech Systems Corporation over claims inadequate data security measures put in place by the company were to blame for a 2021 data breach.
