Plaintiff Richard Tuso filed a class action lawsuit against Rocket Mortgage LLC claiming that the company repeatedly texted him despite attempts to opt out from the Rocket Mortgages texts and being on the National Do Not Call Registry.
“The unauthorized telephone calls placed by Defendant, as alleged herein, have harmed Plaintiff Tuso in the form of annoyance, nuisance, and invasion of privacy, and disturbed the use and enjoyment of his phone, in addition to the wear and tear on the phone’s hardware (including the phone’s battery) and the consumption of memory on the phone,” the Rocket Mortgage class action says.
Tuso has been a member of the National Do Not Call Registry since 2003 and received multiple Rocket Mortgage texts and Rocket Mortgage calls in early 2023 sending a text and telling the caller that he wanted to be removed from the Rocket Mortgage call list.
Plaintiffs seek $500 to $1,500 in damages per text or call to members of two classes, lawsuit states
The lawsuit is looking to establish two classes, one with members of the National Do-Not-Call Registry and another from Rocket Mortgage’s internal do-not-call list. Members of the class need to have received multiple unsolicited calls or text messages during a year and the class member also attempted to opt out of the Rocket Mortgage texts or Rocket Mortgage calls.
The class is asking for $500 per instance for the National Do Not Call Registry class and $1,500 per instance for the internal do-not-call list class as well as an injunction against the Rocket Mortgage texts and Rocket Mortgage calls and attorneys’ fees.
Rocket Mortgage faced a class action lawsuit last year over its aggressive marketing campaigns where people would receive repeated unsolicited text messages or phone calls despite attempts to opt out.
