Plaintiff Wayan Garvey filed a class action lawsuit against Keller Williams Realty, Inc., and agent Britney Gaitan stating that the agent and company make repeated unsolicited automated calls and text messages to potential customers who are on the National Do-Not-Call Registry.

The Keller Williams calls and text messages violate the Telephone Consumer Protection Act, according to the Keller Williams class action lawsuit. Using an artificial or prerecorded voice to make unsolicited calls is prohibited by the TCPA.

Garvey began receiving unsolicited calls and text messages on his cell phone from Keller Williams on or about April 26 after being on the National Do-Not-Call Registry since 2006.

“As taught and instructed by Keller Williams, with the tools provided by Keller Williams, Gaitan began making unsolicited prerecorded calls and sending unsolicited text messages to Mr. Garvey marketing Defendants’ services,” the lawsuit claims.

The repeated calls and text messages were annoying, a nuisance and wasted the time of Garvey and members of the class, the Keller Williams lawsuit states. The prerecorded call class members are asking for $500 in damages per call and $1,500 in damages if the defendants’ actions were knowing and willful.

The same damages, $500 or $1,500 if knowing and willful, are being asked for related to those who received calls but are on the National Do-Not-Call Registry.

Keller Williams Realty also faced a class action lawsuit in 2019 claiming it was making unsolicited pre-recorded robocalls to numbers on the National Do-Not-Call Registry.

    Britney has called me with robocalls more than 6 times. I also have 3 text messages from her. I plan on joining this class action lawsuit. What a lazy unethical agent!

    I received unwanted calls from Keller Williams and was included in the last class action lawsuit; however, when I contacted the class action settlement administrator to follow up on my payment status, I was informed that my payment went to my old address, and was returned to them as undeliverable, and all payments were exhausted. I never received any payment. Please include me.

    Yes.I’m a buisness owner.and this is a absolute waste of time.I’m a sibgke tattoo artist and every time they call I have to stop and devolve.
    Idek how many calls I’ve missed not answering them bc I think it’s them.This being the reason I looked up class action.We’re talking2-10 calls a day.and I’ve been callled white trash by them.
    I’ve spoke man to everyone possible.I have to do something bc it’s fkn up my biz.

    My husband and I are Realtors and he receives a call a week from a KW agent. He tells them he is also an agent and asks them to remove him – but it never fails a week will go by and another KW agent is calling him. His number is on the Do Not Call list. He even had an ethics complaint filed against him because one KW agent text instead of called asking if he wanted to see a property, his rely was “sure”, not a date or time. This agent waited until the 179th day and filed an ethics complaint because he did not identify himself as an agent and our Association Prof. Standards found him in violation of Article 3 for not identifying himself as an agent. His only reply was “sure” and when the agent could not get any further response from him, she looked the phone number up and found out he was an agent and got extremely hacked off. The ethics issue was over 2 years ago and the phone calls keep coming. Filed with FTC – no response from them. Would love to know how to get involved in this most recent class action suit against this.

    I keep getting unwanted text messages from health care providers trying to get me to switch coverage. I opted out but the text messages just keep coming. I even threatened them with a lawsuit but it hasn’t stopped. I’ve been on the do not call list for 17 years but I still get calls and text.

    I’ve blocked a ton of these numbers and they still keep coming. Should I take legal action?

      Same. It always says that they work with members of NAR to get discounted health insurance. I’ve probably blocked well over 100 phone numbers with the same message. And they still keep coming.
