Wabtec was negligent in its data security, leading to a cyber attack affecting current and former employees, a new class action lawsuit alleges. 

Plaintiff Stephen Pfister filed the class action lawsuit against Westinghouse Air Brake Technologies Corporation (Wabtec) on April 12 in a Pennsylvania county court. On the same day, it was removed to a federal court.

According to the lawsuit, on June 26, 2022 Wabtec lost control over its computer network and the highly sensitive personal information stored on the computer network in a data breach by cybercriminals. Wabtes is a digital transport and equipment solutions company.

The number of total breach victims is unknown, but the plaintiff said he believes the breach impacted at least thousands of former and current employees.

Pfister said the data breach began on or around March 15, 2022, when malware was introduced into Wabtec’s system, and was not discovered by the company until over three months later, on June 26, 2022. 

Following an internal investigation, Wabtec learned cybercriminals gained unauthorized access to current and former employees’ personally identifiable information (PII) and private health information (PHI), he said. 

“On information and belief, cybercriminals bypassed Defendant’s inadequate security systems to access current and former employees’ Sensitive Information in its computer systems.”

Wabtec obfuscated the details of the data breach, lawsuit states

Wabtec reportedly took months to notify alleged victims of the breach, and is still notifying them now, the lawsuit stated.

Meanwhile, it said Wabtec “obfuscated the nature of the breach” and the threat it posed by “refusing to tell its current and former employees how many people were impacted, how the breach happened, or why it took the Defendant over six months to begin notifying victims that hackers had gained access to highly private Sensitive Information.”

As a result, Pfister seeks to represent anyone in the U.S. who are current or former employees of Wastes and whose sensitive information was accessed in the breach.

He is suing for negligence, breach of contract and unjust enrichment and seeks certification of the class action, damages, fees, costs and a jury trial.

Meanwhile, U.S. cybersecurity officials have warned hundreds of thousands of 3CX clients worldwide may be affected by a recent cyberattack against the phone software company’s video conferencing desktop app.
