A new class action lawsuit alleges Nissan North America failed to protect the personal information of its current and former employees from a data breach.
Two former Nissan employees filed the class action lawsuit against Nissan after receiving breach notification emails informing them their personal identifiable information (PII) was compromised.
The plaintiffs claim Nissan used Oracle PeopleSoft software to manage employee information, including payroll, tax administration and other personnel records, but lost control of that data when cybercriminals hacked Oracle.
“Defendant relied on Oracle to store a litany of highly sensitive personal identifiable information — about its current and former employees. But [Nissan] lost control over that data when cybercriminals hacked Oracle in a data breach,” the Nissan class action lawsuit says.
The class action lawsuit alleges the Nissan data breach compromised plaintiffs’ and class members’ names, Social Security numbers, contact information, banking information, financial and tax information, and dependent and/or beneficiary information.
The plaintiffs claim Nissan reported the data breach to the California Attorney General’s Office, saying the incident began on May 27, 2026, but the company did not begin notifying affected individuals until June 25, 2026.
“Thus, [Nissan] kept the class in the dark — thereby depriving the class of the opportunity to try and mitigate their injuries in a timely manner,” the lawsuit alleges.
Nissan data breach: Hackers targeted employee data in ShinyHunters attack
The Nissan class action lawsuit identifies the cybercriminals responsible for the data breach as the “ShinyHunters” ransomware gang. The plaintiffs claim their personal information has already been published, or will be published imminently, on the dark web as a result of the breach.
The class action lawsuit seeks to represent a nationwide class of all individuals whose PII was compromised in the data breach affecting Nissan in May and June 2026, including all those who received notice of the breach. The complaint alleges the proposed class includes at least 20,648 members.
The plaintiffs are demanding a jury trial and requesting declaratory relief, injunctive relief and damages for themselves and all class members.
Early this year, Nissan agreed to a $1.5 million settlement over claims related to a November 2023 data breach, while FCA US was hit with a class action over claims the ransomware group Everest accessed customer information on Stellantis-related systems.
