Florida-based Independent Living Systems failed to implement basic security procedures, leaving sensitive patient information vulnerable to a data breach, a class action lawsuit alleges.

Independent Living Systems is a healthcare administration and managed care solutions provider that serves more than 4.2 million individuals.

Plaintiff David Perez says he received notification March 14 that his personal identification information and personal health information had been exposed in the Independent Living Systems data breach.

Patient information exposed in the data breach reportedly included patients’ names, addresses, birthdates, driver’s license numbers, Social Security numbers, medical record numbers, Medicare or Medicaid identification numbers, financial account information, diagnosis information, treatment information, prescription information, health insurance information and other sensitive data.

An unauthorized third-party reportedly accessed patient data between June 30 and July 5, 2022. However, Perez says, affected patients were not notified their personal data had been compromised until more than eight months later.

Independent Living Systems class action says data breach puts patients at increased risk of identity theft, fraud

As a result of the data breach, patients are at increased risk of identity theft and financial fraud, the class action lawsuit explains. Those affected must spend significant time and money to mitigate the risk by monitoring their credit, financial accounts, health records and email accounts, Perez says.

The Independent Living Systems class action lawsuit alleges the defendant utilized inadequate data security measures to protect patient data even though it knew a data breach could put patients at risk of identity theft and fraud.

“These risks are not theoretical,” the Independent Living Systems class action lawsuit says, pointing to high-profile data breaches that affected Anthem, Equifax, Facebook, Marriott, Yahoo and other companies.

In addition to increasing the risk of identity theft and fraud, medical data breaches pose a unique risk. The compromised data can be used to commit medical fraud and to submit false medical claims for reimbursement, Perez claims.

He claims Independent Living Systems breached its duty to protect patients’ private health information.

The class action lawsuit asserts claims of negligence and declaratory judgment.

Even though federal regulations have been implemented to protect medical records from wrongful disclosure, healthcare data breaches have affected millions of medical records in the United States.

    Please Add Me to this lawsuit, I received a letter that stated that this was a Notice Of Data Incident from Independent Living Systems that was sent out on on March 13 2023. that informed me that my health Information had been compromised.

    On March 14,2023 I received a four page letter from, Independaent Living Systems, P.O.Box 999 Suwanee, GA 30024, telling me that my Data was breached. Since I have heard nothing more about the data breach, I have no further information. I had to change my phone and pass words. I have the letter that Independent Living Systems sent to me. I am a disabled senior on social security and I am not going to tolerate, being put at risk. Things are hard enough, without being put at risk with people I trust to keep my personal, account and recorded information safe. I do have Kiaser and it was listed.
