  • Who: Plaintiff Shannon Rung filed a class action lawsuit against Citizens Bank N.A.
  • Why: Rung claims Citizens Bank failed to properly secure and safeguard private information that was compromised in a data breach publicly announced in October.
  • Where: The class action lawsuit was filed in Rhode Island federal court.

Citizens Bank was hit with another class action lawsuit following allegations it failed to properly secure and safeguard private information during a September data breach.

According to a data breach notice, the intrusion was detected on Sept. 10 and publicly announced via the California Attorney General on Oct. 19.

Plaintiff Shannon Rung argues Citizens Bank failed to take precautions to keep the private information secure despite having numerous statutory, regulatory, contractual and common law duties and obligations to do so.

โ€œ[The] defendant breached these duties by failing to exercise reasonable care in safeguarding and protecting the plaintiffโ€™s and class membersโ€™ private information,โ€ the Citizens Bank class action lawsuit says.

Rung wants to represent a nationwide class of consumers who entrusted Citizens Bank with their private information that was impacted in the data breach publicly announced in October.

Class action: Citizens Bank data breach victims suffered damages

Rung claims she has suffered damages as a result of the data breach, including lost time and money related to monitoring her accounts and credit reports for fraudulent activity, loss of privacy and emotional distress.

โ€œ[She] anticipates spending considerable time and money on an ongoing basis to try to mitigate and address harms caused by the data breach,โ€ the class action lawsuit says.

The Citizens Bank data breach reportedly compromised the names, Social Security numbers, dates of birth, phone numbers and email addresses. Affected individuals have been offered free identity theft and credit monitoring services for two years.

Rung claims Citizens Bank is guilty of negligence, negligence per se, unjust enrichment, breach of implied contract and breach of confidence. She demands a jury trial and requests declaratory relief and an award of statutory damages for herself and all class members.

In related news, a separate class action lawsuit was filed against Citizens Bank in May following an April data breach that involved a third-party vendor.
