Illinois Gastroenterology Group (IGG) agreed to a class action lawsuit settlement to resolve claims it failed to protect patient information from an October 2021 data breach; a claim form is required for class members to benefit. 

The IGG settlement benefits individuals whose personal identifying information, protected health information and/or protected biometric information was compromised in the Illinois Gastroenterology Group data breach on Oct. 22, 2021.

The settlement also benefits a California subclass of individuals whose personal health information was compromised in the data breach.

In April 2022, Illinois Gastroenterology Group revealed an October 2021 data breach compromised the information of 227,943 patients. A subsequent class action lawsuit against the company claimed Illinois Gastroenterology failed to protect patient data through reasonable cybersecurity measures.

Illinois Gastroenterology Group is an independent gastroenterology practice in the Chicago area. In 2019, the group joined GI Alliance, a national gastroenterology organization. 

IGG hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum in the settlement to resolve the data breach class action lawsuit.

Under the terms of the settlement, class members can receive various forms of compensation based on which of their information was compromised and any damages they sustained due to the data breach.

Class members whose Social Security numbers or biometrics were compromised and all California subclass members can receive a cash payment of $150. Class members whose Social Security numbers were not compromised but whose health information was breached can receive a cash payment of $50.

Class members who experienced damages as a result of the data breach can choose to receive reimbursement for documented losses instead of the flat rate payments described above. The settlement allows claimants to receive up to $200 for ordinary losses, three hours of lost time at $25 per hour, and up to $5,000 for extraordinary monetary losses.

All class members are eligible for three years of free credit monitoring services. This benefit includes one bureau credit monitoring and $1 million in identity theft protection and identity-restoration services. 

The deadline for exclusion and objection is May 17, 2023.

The final approval hearing for the settlement is scheduled for June 22, 2023.

To receive benefits under the IGG settlement, class members must submit a valid claim form by June 16, 2023.
