Fortra data breach class action lawsuit overview:

Software company Fortra bears responsibility for a January data breach that compromised the personally identifiable information and personal health information of more than one million of its customers, a new class action lawsuit alleges. 

Plaintiff Branton Underwood, along with a minor plaintiff, claim Fortra instituted “impermissibly inadequate data security” that they argue allowed a Russian-linked hacker/ransomware group to successfully conduct the cyberattack. 

“As evidenced by the Data Breach, Defendant inadequately maintained its network, platform, and software — rendering these easy prey for cybercriminals,” the Fortra class action states. 

The data breach exposed personally identifying information including Social Security numbers, names, addresses, birthdates, employer identification numbers and driver’s license numbers, among other things, according to the class action.

Underwood and the minor plaintiff want to represent a nationwide class of all persons who had their personally identifiable information or personal health information compromised in the data breach. 

Fortra aware it was at heightened risk of suffering data breach, class action says

Underwood and the minor plaintiff argue Fortra was aware it was at a “heightened risk” of being victimized by a data breach on account of its alleged “inadequate data security” they claim left it vulnerable to “exfiltration, compromise, and theft.” 

Further, Underwood and the minor plaintiff claim Fortra “failed to provide timely notice” of the data breach to its customers, “thereby exacerbating their injuries.” 

“Ultimately, Defendant deprived Plaintiffs and Class Members of the chance to take speedy measures to protect themselves and mitigate harm,” the Fortra class action states. 

Underwood and the minor plaintiff claim Fortra is guilty of unjust enrichment, negligence and negligence per se. 

The plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory, treble and punitive damages for themselves and all class members. 

In other recent data breach news, AI chatbot ChatGPT suffered a data breach earlier this month that exposed the personal and financial information of certain ChatGPT users to a small percentage of ChatGPT Plus subscribers.

    I received a letter that my child’s information was compromised due the data breach AND my contact info was used at the hospital (phone #, email, etc.)
    Since then I receive dozens of spam/phishing emails daily and multiple spam/phishing calls and texts. All started after the data breach.
