Fortra data breach class action lawsuit overview:

Software company Fortra bears responsibility for a January data breach that compromised the personally identifiable information and personal health information of more than one million of its customers, a new class action lawsuit alleges. 

Plaintiff Branton Underwood, along with a minor plaintiff, claim Fortra instituted “impermissibly inadequate data security” that they argue allowed a Russian-linked hacker/ransomware group to successfully conduct the cyberattack. 

“As evidenced by the Data Breach, Defendant inadequately maintained its network, platform, and software — rendering these easy prey for cybercriminals,” the Fortra class action states. 

The data breach exposed personally identifying information including Social Security numbers, names, addresses, birthdates, employer identification numbers and driver’s license numbers, among other things, according to the class action.

Underwood and the minor plaintiff want to represent a nationwide class of all persons who had their personally identifiable information or personal health information compromised in the data breach. 

Fortra aware it was at heightened risk of suffering data breach, class action says

Underwood and the minor plaintiff argue Fortra was aware it was at a “heightened risk” of being victimized by a data breach on account of its alleged “inadequate data security” they claim left it vulnerable to “exfiltration, compromise, and theft.” 

Further, Underwood and the minor plaintiff claim Fortra “failed to provide timely notice” of the data breach to its customers, “thereby exacerbating their injuries.” 

“Ultimately, Defendant deprived Plaintiffs and Class Members of the chance to take speedy measures to protect themselves and mitigate harm,” the Fortra class action states. 

Underwood and the minor plaintiff claim Fortra is guilty of unjust enrichment, negligence and negligence per se. 

The plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory, treble and punitive damages for themselves and all class members. 

In other recent data breach news, AI chatbot ChatGPT suffered a data breach earlier this month that exposed the personal and financial information of certain ChatGPT users to a small percentage of ChatGPT Plus subscribers.

    I received a letter from nations benefits stating they provide administration services to my health insurance provider and that Nations Benefits used software by Fortra which experienced a security leak. It further stated that all information about my name, gender, insurance provider number, address, phone number and birthday were all involved. How do I go about joining the class action lawsuit?

    I received a letter stating that Fortra experienced a security incident between January 28 2023 and January 30 2023. Which resulted in my personal and medical information was disclosed.I’ve had to Cancel my Bank Card due to charges I have not made Change passwords etc.Also getting calls.from people I do not know stating my phone number was on their Caller I.D.Now I have to change my phone number plus other incidents that has happened.When you disclose this information to a Healthcare Provider,You expect it to be safe.!!!Its Been a real Headache and Alot of stress dealing with all.of this!!.

        Changed from Aetna insurance to United Healthcare but still got the notice about my information at Nations benefits being breached because of Fortra. April 27th is when the notice was sent.

    I just received a letter informing me my first, middle , last name, gender, health plan subscriber identification number, address , telephone number, date of birth and medical records was one of the cybersecurity attack from “Fortra, LLC” . I’m devastated . I want to be part of the lawsuit. I have medical issues I do not share with anyone but my doctor and now someone is using them? I’m a single older lady that lives alone and now some idiot could come kill me. I’m so upset now it’s affecting my health. Who do I call to file a lawsuit?

    I am just now getting a letter informing that my information was stolen February 9 2023 this is May 5 2023 . I would like to know whom do I need to contact about this problem. My medical information was also included.

    My clients concern was that of her personal address being exposed. She has problems with stalking & her credit is already frozen so exposing a new address to unbeknownst eyes is concerning. I notice also intimate details about the company that were “subliminals” & I’ve been doing some research how FBI analyze things & learning not to overlook these signs for paranoid or delusional but to take them with a grain of salt. Not to be so personal but “fortra” sounds like “for Tara” who for my client is personally is a woman who was to her a main character in an operation of being forced to child snuff porn. There’s a Charles bank connection with the company that I know to be a company a Tammi works security for Charles Swab. Both women were legal mother’s who abused & or were accessories to a child victim. A Kate Bolseth triggered the sound of a perversion in names & I questioned if it was real only considering all the information did I make that judgement as Tara had another step daughter named Katelyn who may have also been snuffed. The company was founded in 1982 the year of Tara’s son Jerrod & a “main character” in the company was a “Matthew” the name of a deceased son of Tara. I found that the fortra data breach also targeted briteline a group of mental health children in particular concerning that I’ve unmasked that fortra sounds like “for Tara” who is known to me an abuser of children in a manner of forced drugs & child death porn & exploitation. Tara was also from Minnesota as is the company fortra founded. Tara & Tammi also lived in Colorado where they shared an ex husband elijah now in Arkansas who has also been known as a fraudulent religious minister who abducts & abuses children as well as adults.

    Just received letter dated April 27, 2023 that NationsBenefits, a company that provides benefits administration services to health care insurer, Aetna, used software provided by Forta, LLC to exchange files with my health plan with Aetna. Letter states “on or around January 30, 2023, Fortra experienced a data security incident in which a malicious actor(s) accessed or acquired the date of multiple organizations, including NationsBenefit.” The personal information included First and Last Name, Gender, Health Plan Subscriber Identification Number, address, phone, date of birth and medicare number. I would like to know what my options are if I join the class action suit against Forta.
