Vimeo subscriptions class action lawsuit overview:

  • Who: Psalm Pollock filed a class action lawsuit against Vimeo.com Inc.
  • Why: Pollock claims Vimeo unlawfully enrolls its subscribers into automatic-renewal programs without their knowledge.
  • Where: The class action lawsuit was filed in California federal court.
  • What are my options: Try Microsoft for alternative video-editing software.

Vimeo.com engages in an unlawful “automatic renewal” scheme that affects consumers who sign up for subscriptions with the video hosting, sharing and streaming platform, a new class action lawsuit alleges.

Plaintiff Psalm Pollock claims Vimeo fails to make disclosures required by law before allegedly placing consumers who subscribe to programs that automatically renew from month to month or year to year.

Pollock argues the alleged automatic enrollment ultimately causes Vimeo subscribers to incur monthly or annual charges on their method of payment.

“Defendant has made the deliberate decision to charge … customers on a recurring basis, relying on consumer confusion and inertia to retain customers, combat consumer churn, and bolster its revenues,” the class action states.

Pollock wants to represent a California class of consumers who have incurred a renewal fee after signing up for a Vimeo subscription.

Vimeo makes it ‘exceedingly difficult’ to cancel subscription, class action says

Vimeo subscribers who are allegedly unwittingly placed in automatic-renewal programs have complained to the Better Business Bureau about the practice, the Vimeo class action alleges.

“Numerous subscribers have left scathing reviews on the Better Business Bureau website, complaining of confusion regarding obscured or undisclosed subscription terms,” the Vimeo class action states.

Pollock argues Vimeo subscribers alleged complaints have revolved around claims of unclear free trials and billing practices and a confusing subscription cancellation policy.

“Defendant … makes it exceedingly difficult and unnecessarily confusing for consumers to cancel their Vimeo Subscriptions,” the Vimeo class action states.

The plaintiff claims Vimeo is guilty of unjust enrichment, fraud, negligent misrepresentation and conversion, and of violating California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act.

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, compensatory, statutory and/or punitive damages for herself and all class members.

A number of similar class action lawsuits have recently been filed against companies — including The Athletic, HungryRoots and FloSports — accused of unlawfully enrolling their subscribers into automatic renewal programs.

Vimeo also recently agreed to a settlement resolving claims the company wrongfully collected facial geometry scans from its Magisto app for identification purposes.

The plaintiff is represented by Neal J. Deckant, Julia K. Venditti and Frederick J. Klorczyk III of Bursor & Fisher PA and Adrian Gucovschi of Gucovschi Rozenshteyn PLLC.

The Vimeo subscriptions class action lawsuit is Pollock, et al. v. Vimeo.com Inc., Case No. 3:23-cv-00602, in the U.S. District Court for the Southern District of California.
