Data breach class action lawsuits overview: 

  • Who: Consumers recently filed data breach class action lawsuits against BetMGM, LastPass, the San Francisco 49ers, Neopets-maker JumpStart Games, Ethos Technologies and Guidewire Software.
  • Why: Consumers claim the companies failed to prevent data breaches through negligence and/or having relaxed cyber security procedures in place. 
  • Where: Data breaches affect consumers nationwide. 

Consumers filed a number of class action lawsuits recently against several major companies, accusing them of failing to prevent data breaches that exposed and/or compromised personal and private consumer data. 

The consumers claim the companies bear responsibility for the hacking incidents due to their own alleged negligence by having relaxed and/or inadequate cybersecurity policies in place. 

Data breaches have become increasingly common recently, with a total of 452 million reported in the last three years in the United States alone. 

BetMGM accused of failing to ‘properly secure and safeguard’ consumer info during data breach

A consumer filed a class action lawsuit against BetMGM last month, arguing the sports betting company failed to “properly secure and safeguard” customer information during a May 2022 data breach. 

The consumer claims BetMGM negligently stored customer data in an environment that was allegedly both unencrypted and accessible by internet. 

LastPass hit with claims it bore responsibility for August 2022 data breach

A consumer hit LastPass with a class action lawsuit earlier this month, claiming the company bore responsibility for an August 2022 data breach by allegedly neglecting data security

The consumer behind the complaint argues LastPass failed to exercise reasonable care in protecting the customer data, ultimately leading to its unauthorized release to the public and eventual misuse. 

San Francisco 49ers faces claims it failed to safeguard private fan, employee data

The San Francisco 49ers, meanwhile, faced claims last month that the National Football League franchise failed to safeguard the private data of its fans and employees during a February 2022 ransomware attack. 

The consumer behind the complaint argues the 49ers alleged failure to protect the data led to thousands of its fans and employees having their personal information compromised. 

Neopets maker accused of failing to prevent more than yearlong data breach 

A consumer filed a class action lawsuit against Neopets maker JumpStart Games earlier this month, arguing the company could have prevented a more than yearlong cyberattack that exposed private data

The consumer behind the complaint argues JumpStart was negligent in allowing the data breach, which exposed personally identifiable information such as names, email addresses and usernames, among other things, to occur. 

Ethos Technologies, Guidewire failed to safeguard private data during cyberattack, class action says

Earlier this month, a consumer hit Ethos Technologies and Guidewire Software with a class action lawsuit earlier this month, claiming the companies failed to safeguard private data during a cyberattack that began in August of last year. 

The consumer behind the complaint argues Ethos and Guidewire bore responsibility for the cyberattack, which ran through December 2022, by allegedly storing the data in an unencrypted and internet-accessible environment. 

FBI investigating apparent 3commas data breach after Twitter users claims to have leaked API keys

A number of data breaches have also recently occurred that, as of this writing, have not resulted in class action lawsuits yet.

The Federal Bureau of Investigations, for example, began investigating an apparent data breach against the Estonia-based crypto trading service 3commas. 

The potential 3commas data breach came to light after an anonymous Twitter user claimed to have leaked more than 10,000 API keys belonging to 3commas users earlier this month while stating an intention to release more. 

Five Guys discloses data breach affecting job applicants

Five Guys, meanwhile, disclosed earlier this month that it suffered a data breach that it says exposed the private information of job applicants

Five Guys says the data breach affected files containing private information job applicants sent as part of the company’s employment application process. 

Wabtec blames malware while disclosing data breach dating back to last March

Also this month, Wabtec Corporation disclosed that it was the victim of a data breach last year that began as far back as March 15, 2022.

Wabtec, a rail and locomotive company, blames the data breach on malware that it says a threat actor installed on some of its systems. 

Cybersecurity monitoring firm co-founder claims Twitter suffered data breach affecting more than 200 million users

Alon Gal, co-founder of Israeli cybersecurity-monitoring firm Hudson Rock, claims Twitter suffered a data breach that affected more than 200 million of the social media company’s users. 

Gal claims hackers stole the email addresses of more than 200 million Twitter uses and subsequently posted them on an online hacking forum. Twitter has reportedly not responded to the allegations.

    I’ve had the hospital send me a letter telling me they have had a data breach. Also I took Tylenol while pregnant and one child of mine has add and spinal bifda.

    There’s a online cleaning company name homeAglow let someone get my bank info SS number DOB and other important information the person found me on Facebook and sent a picture of all my info

    Seriously? These companies keep claiming ransomware attacks,but nobody tries to fix the security,and the hackers just keep stealing and selling our data? How can we feel secure at home on our computers, if the Credit Companies-to begin with The people who control our credit scores,phone numbers,addresses,history and even geological locations, they can’t keep their security in place either. I get weekly alerts from my identity monitoring service- but whats the point when the next Hospital,doctors office,bank, is going to have a breach?Sometimes more than one. Its totally unacceptable. Somewhere out in the Dark web universe My Name,Social Security Number,birth date, even my email & IP address is being sold. I worried all these years about banking online, and paying with my debit cards online in case I got hacked. But Guess what- I’ve Never had a security issue at home. Only out there. So thanks
