49ers breach class action lawsuit overview:

  • Who: Plaintiff James Sampson filed a class action lawsuit against the San Francisco 49ers.
  • Why: The 49ers allegedly failed to adequately safeguard sensitive data, leaving it vulnerable to cybercriminals who gained access to the data through a ransomware attack.

The San Francisco 49ers failed to properly safeguard data prior to a ransomware attack that allegedly compromised the personal information of thousands of football fans, according to a class action lawsuit filed Dec. 22 in California federal court.

Plaintiff James Sampson says he was one of the 49ers fans affected by the data breach and has experienced at least two fraudulent purchases on the same credit card he used to purchase from the 49ers.

The 49ers class action lawsuit alleges the NFL team failed to properly secure and safeguard confidential information that it obtained from fans and employees, including names, Social Security numbers, payment card information and other personal identification information (PII).

In February 2022, ransomware reportedly infected the NFL team’s servers, and cybercriminals took control of the computer network, leading to the exposure of personal data contained on the server, according to the 49ers breach class action lawsuit.

“Defendant is a highly sophisticated business enterprise worth billions of dollars and yet neglected to take basic and necessary steps to ensure that the PII it collected from consumers and its employees was effectively protected against the foreseeable threat of a targeted data breach,” the 49ers class action lawsuit says.

Sampson claims the 49ers failed to encrypt or redact the highly sensitive information contained on its servers, making it possible for hackers to access the data and exploit the information.

The team did not notify victims of the 49ers breach that their personal information had been compromised until August, allegedly leaving the victims vulnerable to identity theft, fraud and other criminal activity, according to the lawsuit.

“As a result of Defendant’s failure to implement adequate data security protocols, the risk of fraud and identity theft to these consumers will remain for their respective lifetimes,” the 49ers class action lawsuit says.

The 49ers breach class action asserts claims for negligence, breach of implied contract, invasion of privacy and violations of the California Consumer Privacy Act and Unfair Competition Law.

At least 20,000 individuals have reportedly been affected by the 49ers breach.
