Spectrum violated the law by “pounding” a South Carolina woman with dozens of unwanted phone calls that were not for her, a new class action lawsuit alleges.

Plaintiff Judy F. Mulvihill filed the class action lawsuit against Charter Communications Inc. — doing business as Spectrum — on July 21 in a South Carolina federal court, alleging violations of the Telephone Consumer Protection Act (TCPA).

According to the lawsuit, in March 2023, Spectrum started placing phone calls to Mulvihill’s cellphone number in an attempt to contact an individual who is unknown to her, named “Zachary Kelly.” 

Upon answering the first call, Mulvihill says she was greeted with a prerecorded voice, before being transferred to a live representative.

Mulvihill says she advised the representative she was not the person the company was looking for, and asked Spectrum to stop calling her, but the calls persisted.

“Despite Plaintiff’s request that Defendant cease its misguided calls, Defendant continued pounding Plaintiff with calls in an effort to contact an unknown third party,” the lawsuit states.

“In total, Defendant placed no less than forty-two robocalls to Plaintiff’s cellular phone number from March 2023 through the present.” 

Robocalls harmed plaintiff and others, lawsuit alleges

Spectrum’s misguided robocalls invaded Mulvihill’s privacy and caused her aggravation, wear and tear to her cellphone, loss of battery charge, nuisance, wasted time and more, she says.

As a result, she’s looking to represent anyone in the United States to whom Spectrum placed a phone call to their cellphone using a prerecorded voice without their consent, in the past four years.

She seeks certification of the class action, damages of up to $1,500 per TCPA violation, fees, costs and a jury trial.

Meanwhile, in March, Charter Communications was hit with a class action lawsuit alleging it violates the law by stopping its customers’ internet immediately after they cancel their service plans, even though they have paid for their services to the end of the month.

    Spectrum lies and gives horrible services in Texas. I was told I was at 500mbs then dropped to 300mbps and my internet now apparently has a signal issue and they are coming here tomorrow. My guess they will say my modem which is top of the line and on their LIST of modems they take. I will not put up with this. As for the robo calls and thousands of mobile phone ads I receive this is also harassment.

    I get at least 2-3 calls per month… annoying. Told them over and over. No bundle, I only use internet and stream. That why I nicknamed them Sprectum, because their a pain – – –

    Add my name, multiple unsolicited robocalls over the past months. They are an intrusion and unwanted. Also despite the fact that they were made aware that my number was on the National Do Not Call Registry, the calls continued.
