Spectrum Illegal Call Recordings Lawsuit Overview:

  • Who: A California woman has sued Charter Communications Inc., which owns Spectrum.
  • Why: The plaintiff claims Charter secretly recorded a call with a Spectrum representative in violation of California law.
  • Where: The lawsuit is being heard in federal court in Northern California.

The company that owns Spectrum has been covertly and illegally recording customers’ inbound and outbound calls to the cable and internet brand, a new class action lawsuit alleges.

In a class action complaint moved to California federal court Tuesday, California woman resident Loretta Johnson alleges Charter Communications Inc. has violated the California Invasion of Privacy Act (CIPA), Law360 reports.

Johnson alleges that a call she had with a Spectrum representative was secretly recorded without her consent. The class action lawsuit alleges Charter has been automatically recording all inbound and outbound customer calls in the state.

CIPA is a law that helps to ensure that your conversations are not recorded without your knowledge or consent. This not only applies to telephone conversations, it also covers any scenario in which you and another party have a “reasonable expectation of privacy” as defined by statute.

Violators who fail to warn that a recording is being made of a private conversation can be held liable and may face criminal penalties as well.

Johnson is seeking damages under CIPA of up to $5,000 for every call to a California resident that was covertly recorded by Charter. 

According to Law360, Charter itself estimated the number of calls recorded at about 1,500 in a motion to move the case to federal court. 

The company has denied any wrongdoing. 

This is not the only class action lawsuit Charter is facing. Last year, Charter customers filed a class action lawsuit saying that the communications company misled its customers about the costs of its Spectrum cable television services.

The Charter class action lawsuit was filed by customers who say the company deceptively increases the monthly rate, charges undisclosed fees, reduces the number of channels included in its packages, and makes it hard for customers to cancel their service subscriptions. 

The plaintiffs say that they were all offered a lower monthly rate that was then raised, contrary to what the company advertised.

    Please add me to the list, Spectrum from day 1 has given me misinformation and added lines I never asked for, the worst thing they did after I called and told them there was fraud on my auto pay card and not to run it, I’d get back within 5 days with new account info, Spectrum ran it, my bank paid it, and I’m stuck with overdraft fees, I’m disabled on SSDI now I can’t pay November bill and their shutting off my service today, I have televists with 4 specialist Dr week, and I won’t be able to get my medicine, they charge a fee for everything and they refuse to take responsibility for their mistake and know I will suffer tremendously and their bottom line is more important than human beings, I’ve never missed a payment, their notes alleged I made changes I never made. They’re defaming my character and have turn everything they’ve done wrong back on me. I have documented everything and have dates in chronological order. They discriminate against the disabled and extort money out of them. They’re unethical and need to be stopped, they are trying to ruin my credit and I get treated with great disrespect, they are obsessed with corporate greed and that’s all they care about is their bottom line, I will end up hospitalized because of their mistakes, they need to be heald accountable, worst mobile carrier ever.

    I am so tired of complaining and not being listened to. I am being charged for service I don’t have and having monthly payments taken from account. When I ask to cancel they cannot cancel something that is not active, but continue to take payments. They will not remove the account because it’s signed agreement, but they state themselves that there is no account. I am beyond lost and need my information removed from this company (spectrum)

    Spectrum is guilty of a number of unconscionable and questionable Business Practices. I have been with them for 2.5 years, and they keep raising my bill and adding fees and charges that I never agreed too. Also, I canceled my “Ultra Internet” Service, because I live in an apartment building and I was never getting the d/l and u/l speeds they promised me. I called twice to be removed from their “Ultra”, but they kept charging me for it for an additional 9 months. It took too many calls and too many complaints. They are manufacturing numbers and adding fees that make no sense. Also, they FALSELY ADVERTISE that there are “No Hidden Fees”, yet there are two or more. My $85.99 Bundled Cable TV also has an added $21.00 towards the end of the bill that they tack on. Spectrum needs to be reigned in immediately!!

      Spectrum promised me that my landline phone number from another city to the city I moved to another city, in October 2022 they kept saying your number is for sure secured which in November they kept telling me give it a few days, I believed them, then mid November they said I have to have a mobile phone from them, ok I said, then I found after they lied to me that my landline couldn’t work unless I get a mobile phone from them in order to keep my landlines, I received a mobile phone which didn’t work so they had to send me a label to return the phone, 5 days later the label came, I sent it back still believing my 2nd phone will be my landline, it was not so I canceled the service period, I received an email stating that both phones were returned within the 60 days and I don’t owe them, but now they’re telling me the phone was wet , and it is gradedC, and in watered, function, whatever that means, I know when I sent the 2 phones they weren’t broke, here we are in April and they’re still trying to get me to pay them, I have every txt they send for code because I didn’t have my 4 didgeridoo code, please add me to this list,

    My problem with spectrum was about canceling the internet service. I cancel before the cycle end and the customer service was really mean. But he promise that I won’t get another bill. I also return the equipment to them. But a week after that I got another bill that cost more than monthly bill. it said for one time chargers without any other explanation. I’m already past the early termination. already been with them more than 5 years. And their services not the best one. So many lagging and problem. And they promise that they won’t increased the price but in the end they increased 3 times. So can I file a lawsuit to them?

    Is there a way to still be apart of this lawsuit. I have so many problems with spectrum. And they are a company trying to monopolize the industry. I’ve tried reasoning with them but they just don’t care. They bank on that you will just deal. Where has compassion gone?

    Yes, they do record with and without your permission. They also create delay’s in the reception of the incoming calls for what purpose I am unsure but a couple times it named google???. They also collect your cell phone information and then share it with third parties even if you have plainly asked them not to and that you were allowing the alternate use of the number to fix the emergency problem with your main line. I have had many issues with this company. Internet and two lines now. Their excuse is they are chasing a ghost and it will take some time. It’s been a couple years now!!! The employees are great but they are just as frustrated while trying to perform their duties and when they can’t figure out the issue they blame it on you.
