Individuals whose information was accessed during a 2019 data breach may be eligible to benefit from a class action settlement with Beaumont Health and William Beaumont Hospital.
The Class includes anyone who was sent a notice of the data breach announced by Beaumont Health on or about April 17, 2020.
Plaintiffs in a class action lawsuit alleged Beaumont Health and William Beaumont Hospital failed to adequately protect patients’ names, diagnoses, Social Security numbers, account numbers, and other sensitive information during a data breach that occurred between May 23 and June 3, 2019.
On April 17, 2020, Beaumont Health announced that it had been the victim of the Security Incident, which may have impacted the information of certain patients. Beaumont Health began providing notice to individuals whose personal information may have been impacted on the same day. The lawsuit alleges Beaumont and William Beaumont Hospital (together “Beaumont”) failed to adequately protect the information of the potentially affected individuals, and asserts various claims, including breach of implied contract, breach of fiduciary duty, and unjust enrichment. Beaumont contests these claims and denies any wrongdoing.
Beaumont Health denies any accusations of wrongdoing, but both sides have agreed to the settlement.
The Court has not ruled in favor of either party.
Beaumont Health is the largest health-care system in Michigan, with eight hospitals (including William Beaumont Hospital), 155 outpatient locations, and more than 33,000 employees, according to its website.
Beaumont Health Data Breach Settlement Benefits
The amount of each Class Member’s payment will vary.
Any Class Member who submits a valid claim for unreimbursed ordinary losses will receive up to $250. These losses may include:
- Bank fees, long-distance phone charges, cellphone charges (only if charged by the minute), data charges (only of charged on the amount of data used), postage, or gasoline
- Fees for credit reports, credit monitoring, or other identity theft insurance products purchased between April 17, 2020, and June 23, 2021
- Up to three hours of lost time at a rate of $20 per hour, as long as the Class Member spent at least one full hour dealing with the data breach
Class Members filing a valid claim for extraordinary losses may receive up to $2,250 if the loss meets all of the following criteria:
- The loss is an actual, documented, and unreimbursed monetary loss
- The loss was more likely than not caused by the data breach
- The loss occurred between May 2019 and Oct. 21, 2021
The Class Member made reasonable efforts to avoid or seek reimbursement for the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance.
Anyone filing a claim must certify they received treatment at Beaumont Health before May 2019 and must submit either a unique identifier provided by the claims administrator to those for whom direct notice can be given or their name, the year or years in which they received treatment at Beaumont, and the location of the Beaumont facility at which they were treated.
Beaumont Health also has implemented improvements and planned for future measures improving its cybersecurity, such as multifactor authentication, and will commit to additional security enhancements in 2021 and 2022.
The estimated value of the improvements already implemented is more than $3 million, and the estimated value of the additional improvements is at least $2 million.
A final approval hearing in the Beaumont Health data breach settlement will take place Oct. 27, 2021.
Those who wish to exclude themselves from or object to the settlement must do so by Sept. 21, 2021.
The deadline to file a claim is Oct. 21, 2021.

I live in Allen Park we have had major male problems my husband and I have both been treated at Beaumont health systems for many years I don’t know if I was supposed to get a mailing due to the problem we’re having. There is a Blue Cross Blue Shield settlement I only received one postcard had to call found out they mailed a second one for my husband in May 2021 but I never received it. How do I find out if we are eligible to file a claim against Beaumont?
