AMN Healthcare has agreed to a $4.5 million class action settlement to resolve claims it violated California privacy laws by recording and monitoring language interpretation sessions without consent.

The AMN Healthcare settlement benefits individuals who were physically present in California and whose communications were monitored and/or recorded by AMN Healthcare, AMN Healthcare Language Services, or other AMN employees, contractors, agents or persons acting on AMN Healthcare’s behalf without obtaining prior consent.

AMN Healthcare is a healthcare staffing company that provides services such as telehealth, workforce solutions, clinical services and more. AMN Healthcare Language Services provides interpretation and translation services to healthcare providers.

According to a class action lawsuit, AMN Healthcare violated the California Invasion of Privacy Act (CIPA) by recording and/or monitoring calls or videos interpreted by AMN in California without the knowledge or consent of plaintiffs and other patients.

AMN Healthcare has not admitted any wrongdoing but agreed to a $4.5 million class action settlement to resolve the alleged privacy violations.

Under the terms of the AMN Healthcare settlement, class members can receive a cash payment based on the number of claims filed with the settlement.

Class members who submit a valid claim form will be paid a proportionate share of the net settlement fund. The net settlement fund will be calculated by subtracting the service award payments to plaintiffs, the costs of administering the settlement and attorneys’ fees and costs from the gross settlement fund of $4.5 million.

No payment estimates are available at this time.

AMN Healthcare also agreed to implement business practice changes to ensure compliance with the CIPA. The company instructed relevant employees to cease recording interpretation sessions in January 2024 and all monitoring of interpretation sessions in November 2024.

The deadline for exclusion and objection to the settlement terms is Oct. 27, 2026.

The final approval hearing for the AMN Healthcare settlement is scheduled for Dec. 18, 2026.

To receive a settlement payment, class members must submit a valid claim form by Oct. 27, 2026.
