Tommy Hilfiger class action lawsuit overview:

A new class action lawsuit accuses Tommy Hilfiger outlet stores in California of luring shoppers with fake discounts from “original” prices at which the merchandise is rarely, if ever, offered for sale.

Plaintiffs Qasem Hashimi and Henry De La Paz claim the practice convinces consumers they are getting a bargain when they are actually overpaying.

Hashimi and De La Paz allege outlet price tags list inflated “original” prices without any “Compare At” language, while nearby signs advertise percentage-off deals. The stores allegedly never disclose when, if ever, an item was last offered at its tagged price.

De La Paz claims he paid about $35.99 for a polo tagged at $69.50 at the Commerce outlet in July 2024, while Hashimi paid $40 for sweatpants tagged at $80 at the Carlsbad outlet in April 2025. Both say they would have paid less, or not bought the items at all, had they known the truth.

The plaintiffs also allege most Tommy Hilfiger outlet merchandise is made specifically for outlet stores with cheaper materials, meaning shoppers are misled about both price and quality.

They want to represent a class of California consumers who bought one or more products from a Tommy Hilfiger outlet store at a discount from an advertised reference price within the applicable statute of limitations and have not received a refund or credit.

Tommy Hilfiger offered no items at ‘original’ price, fake discounts lawsuit claims

The plaintiffs’ attorneys tracked merchandise at California outlets during several periods between February 2022 and July 2025. “Not once during the investigation was a product observed being offered at its full ‘original’ price,” the Tommy Hilfiger class action lawsuit says.

Economists working with the plaintiffs analyzed 113 outlet products and found reference prices averaged 55.3% higher than selling prices. Their preliminary analysis estimates the inflated reference prices pushed selling prices up by about $15.37 per item or roughly 32% of the average purchase price.

A textile expert hired by the plaintiffs’ counsel also compared outlet garments with similar Tommy Hilfiger items sold at Macy’s. The outlet polo used a 60% cotton and 40% polyester blend with a two-button placket, while the Macy’s version was 96% cotton with a three-button placket.

Hashimi and De La Paz claim Tommy Hilfiger violated California’s false advertising, unfair competition and consumer protection laws.

The plaintiffs demand a jury trial and request restitution, injunctive relief and a corrective advertising campaign. They plan to amend the class action lawsuit to seek damages if Tommy Hilfiger does not respond to their legal demand within 30 days.

Meanwhile, a consumer has also accused Kate Spade outlets of falsely advertising discounts to customers by using inflated โ€œcomparable valueโ€ prices.
