Uber class action lawsuit overview:

  • Who: Plaintiff Ashley Jesus filed a class action lawsuit against Uber Technologies Inc. and Uber USA LLC.
  • Why: The plaintiff claims Uber deceptively enrolled customers into its Uber One subscription service.
  • Where: The Uber class action lawsuit was filed in California federal court.

A new class action lawsuit alleges Uber deceived its customers by enrolling them into its Uber One subscription service without their knowledge or consent.

Plaintiff Ashley Jesus claims Uber uses promotional offers to obscure the fact that consumers are being enrolled in a recurring paid subscription to Uber One, which the company offers for $9.99 per month or $96 per year.

โ€œUber markets Uber One through promotional offers presented to existing Uber customers in a manner that obscures the fact that interacting with the promotion may enroll them in a paid, automatically renewing subscription,โ€ the Uber class action lawsuit says.

Jesus wants to represent a nationwide class and California class of all persons who, within the applicable statute of limitations period, were enrolled in and charged for an Uber One subscription after interacting with an Uber promotional offer advertising a discount, credit or other promotional benefit.

Uber customers unaware they were enrolling in Uber One, class action claims

Jesus claims Uberโ€™s customers believed they were accepting a discount, promotional credit or other benefit when, in fact, their interaction with the promotion results in enrollment in Uber One.

Further, Jesus argues Uber charges payment methods already associated with consumersโ€™ Uber accounts, causing them to incur monthly or yearly charges without their knowledge. 

โ€œConsumers are charged Uber One membership fees without having knowingly agreed to purchase an automatically renewing subscription,โ€ the Uber class action lawsuit says.

Uber also makes it difficult for consumers to unenroll from Uber One and stop the recurring charges despite allegedly representing that consumers can โ€œcancel anytimeโ€ with โ€œno additional fees,โ€ the class action lawsuit alleges.

Jesus argues Uber is guilty of fraudulent, unlawful and unfair business practices and violations of Californiaโ€™s Automatic Renewal Law, False Advertising Law, Consumers Legal Remedies Act and Unfair Competition Law.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual, compensatory, statutory and/or punitive damages for himself and all class members.

In similar alleged deceptive practices, a consumer sued Uber Eats earlier this year over claims the company misleads consumers into believing a priority fee would ensure direct delivery.
