American Consumer Credit Counseling (ACCC) has agreed to a class action settlement to resolve claims that it failed to prevent a 2025 data breach that compromised sensitive consumer information.
The American Consumer Credit Counseling settlement benefits individuals whose personal information was potentially compromised in the January 2025 data breach.
Plaintiffs in the American Consumer Credit Counseling data breach class action lawsuit accused ACCC of failing to implement reasonable cybersecurity measures that could have prevented the breach. As a result, the plaintiffs say their information was compromised and put at risk for identity theft and fraud.
American Consumer Credit Counseling is a nonprofit credit counseling agency that helps consumers manage their debt and improve their credit scores.
ACCC has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.
Under the terms of the American Consumer Credit Counseling settlement, class members can receive either a cash payment or a cash payment and credit monitoring.
Class members who experienced out-of-pocket expenses or lost time as a result of the data breach can receive up to $3,500 in reimbursement for documented losses and up to four hours of lost time at a rate of $20 per hour.
Class members who did not experience any losses as a result of the data breach can receive a one-time cash payment of $45.
All class members are eligible for three years of free credit monitoring through CyEx Financial Shield Complete. This service includes $1 million in financial fraud insurance and monitoring for fraud, identity theft and unauthorized transactions.
The deadline for objection to the American Consumer Credit Counseling settlement is Aug. 17, 2026.
The final approval hearing for the class action settlement is scheduled for Oct. 8, 2026.
To receive settlement benefits, class members must submit a valid claim form by Sept. 16, 2026.
