FinWise Bank, FinWise Bancorp and American First Finance agreed to a $2.8 million class action settlement to resolve claims they failed to prevent a 2024 data breach that compromised sensitive consumer information.
The FinWise Bank settlement benefits individuals whose private information was affected by the FinWise Bank data breach on or around May 31, 2024, including those who received a notice of the data breach.
The FinWise Bank data breach allegedly compromised sensitive consumer information, such as names, birth dates, Social Security numbers and account numbers. Consumers took legal action against FinWise Bank, FinWise Bancorp and American First Finance following the breach, arguing the companies could have prevented the data breach through reasonable cybersecurity measures.
FinWise Bank is a financial institution based in Utah that offers personal loans, business loans and other financial services.
The defendants in the data breach class action lawsuit have not admitted any wrongdoing but agreed to resolve the allegations with a $2.8 million class action settlement.
Under the terms of the FinWise Bank settlement, class members can receive a cash payment for documented losses or a proportional share of the settlement fund.
Class members who experienced documented losses as a result of the data breach can receive up to $5,000 in reimbursement. Eligible losses could include unreimbursed fraud, identity theft, credit monitoring expenses, credit report costs and other documented expenses. Class members must provide documentation of these losses with their claim form.
Class members who did not experience documented losses can receive a proportional share of the class action settlement fund. These payments will vary depending on the number of claims filed with the settlement.
California class members may be entitled to additional relief under California’s privacy laws. These class members can receive up to two times the cash fund payment compared to non-California residents.
All class members are eligible for two years of free credit monitoring services. To receive this benefit, class members must select the credit monitoring option on their claim form.
The deadline for exclusion and objection is Sept. 29, 2026.
The final approval hearing for the FinWise Bank settlement is scheduled for Dec. 10, 2026.
To receive settlement benefits, class members must submit a valid claim form by Oct. 29, 2026.
