Astroworld Magic Money Class Action Lawsuit Overview: 

  • Who: Astroworld festivalgoers filed a class action lawsuit against Magic Money LLC and the event’s organizers, including Live Nation Entertainment, Inc. 
  • Why: Plaintiffs claim they are owed a refund after prepaying for Magic Money cards that could be used for rides and games at the event.
  • Where: The class action lawsuit was filed in Texas federal court.

Festivalgoers who purchased Magic Money to pay for rides and carnival games while attending Travis Scott’s Astroworld music festival in Houston, Texas, should be refunded after the second day was canceled, a new class action lawsuit alleges. 

The Astroworld music festival was supposed to run from Nov. 5-6; however, its second day was canceled after a crowd surge during Travis Scott’s performance on the opening night led to 10 deaths and hundreds of injuries

Plaintiffs Brenda Wong, Parker Jerrell, Jose Box and Amber Palmer claim they are due a refund after they were encouraged to prepay for a Magic Money card so they could skip lines for carnival games and rides at the event.  

The plaintiffs want to represent a nationwide class and Texas, Indiana and California subclass of festivalgoers who purchased Magic Money for the event and were not refunded. 

Plaintiffs not refunded after second day of event canceled

The plaintiffs claim they preloaded their Magic Money cards with money and paid the necessary service fees prior to the event; however, they claim they were not refunded after the second day of the event was canceled. 

“Due to the festival’s cancellation, those that incurred costs, such as purchasing Magic Money to pay for the festival’s rides and carnival games, should be refunded,” the class action lawsuit states. 

The plaintiffs claim they were encouraged on social media and the festival’s website to purchase the Magic Money cards and argue the festival had a pecuniary interest in them doing so. 

The plaintiffs argue Magic Money LLC and the event’s organizers, including Live Nation Entertainment Inc., are guilty of unjust enrichment and breach of contract, among other things, and are in violation of Texas’ Deceptive Trade Practices Act

They are demanding a jury trial and requesting relief in the form of actual, statutory, treble, exemplary and punitive damages for themselves and all class Members. 

Travis Scott and Live Nation have faced a wave of class action lawsuits in the wake of the deadly music festival by attendees and on behalf of the deceased.
