Bestway has agreed to a $15 million class action settlement to resolve claims that its above-ground pools are defective and pose a drowning hazard.

The Bestway settlement benefits consumers who purchased a Bestway-branded pool that is 48 inches or taller (including Power Steel and Steel Pro models) with compression straps located outside of the support poles, sold between 2008 and 2024.

According to the class action lawsuit resolved by this settlement, Bestway above-ground pools are defective and pose a drowning hazard. The company allegedly knew about the defect but failed to warn consumers before a July 2025 recall.

Bestway is a pool company that sells inflatable pools, above-ground pools, pool accessories and other outdoor products.

Bestway has not admitted any wrongdoing but agreed to this $15 million class action settlement to resolve allegations.

Under the terms of the Bestway settlement, class members can receive a cash payment based on whether they have proof of purchase for Bestway above-ground pools.

With proof of purchase, class members can receive 10% of the actual price paid for their pool or 10% of the average retail price of their pool if no actual purchase price is available. Without proof of purchase, class members can receive a flat payment of $40.

The deadline for exclusion and objection is Oct. 30, 2026.

The final approval hearing for the settlement is scheduled for Nov. 20, 2026.

To receive a class action settlement payment, class members must submit a valid claim form by Oct. 30, 2026.

If you do not wish to participate in the class action settlement but your family was affected by a recalled pool, you may still qualify for an above-ground pool lawsuit investigation.


Who’s Eligible

The class action settlement benefits consumers who purchased a Bestway-branded pool that is 48 inches or taller in height (including Power Steel and Steel Pro models) with compression straps located outside of the support poles, sold from 2008 through 2024.

Potential Award

Up to $40 without proof of purchase or 10% of the purchase price with proof

Proof of Purchase

Receipt, order confirmation or other documentation that reflects the model number, purchase price and date of purchase
