walmart logoTop Class Actions viewers are starting to receive checks in the mail from a class action settlement that accused Walmart and Sam’s Club of violating labor laws by not paying employees for missed breaks and off-the-clock work.

According to reader comments and posts on the Top Class Actions Facebook page, Class Members who submitted timely and valid claims for the Walmart class action settlement began receiving checks worth as much as $4,406.10 on Dec. 17, 2016.

The Walmart settlement resolves allegations that the retailer did not financially compensate its Pennsylvania employees for missed rest breaks in violation of federal labor laws as well as Walmart’s employee handbook.

According to the class action lawsuit, hourly workers at both Walmart and Sam’s Club within the state of Pennsylvania did not receive pay for tasks performed off the clock or missed meal and rest breaks.

Walmart denied the allegations and appealed the near $141 million verdict to the U.S. Supreme Court. However, the court decided not to hear the case.

Class Members included all hourly workers employed by Walmart or Sam’s Club within the state of Pennsylvania between Mar. 19, 1998 and May 1, 2006.

The deadline to file a claim for the Walmart employee settlement passed on Oct. 1, 2016.

    I have worked for walmart for 12 years in 2 different states and I would like to find out if I am included in this lawsuit. The info. may have been lost in the 5 different addresses I have had since working there, how would I find out? If there is a number or website I could go to please let me know, thanks.

    I habe received my check but by the time I physically got my check I was nolonger able to cash it. What number can I call to speak to someone about a reissued check??

    Still waiting!!!! Someone at Strategic deleted my PO address back in May from their system!!! Therefore my check was sent to the WRONG address and I was therefore told I must now wait another 30-60 days from the time I NOTICED THEIR ERROR before a new check can be issued!!! How is it I being held accountable for a mistake THEY MADE!!!! I NEVER MOVED!!!! Same address for 7 years!!!!!

    I worked there for 20 years, I was always called off of my breaks or called in off of my vocation as a Manager.My market Manager would come in the store five minutes before it was time for me to leave and give me five pages of notes and tell me they had to be done before I went home.He would make me and other Managers for five days on one day off.

      Same company I worked for they say there family not my son was in the hospital I was told I had to come back or lose my job I applied for fmla was told no … worked there 13 yeator so … shortly after all that a temp manager came in and said all management needed to transfer or we were being fired I thought no way … yep sure we’re all management was gone some transferred but for the most part we was all fired

    I am hearing the amounts are much less than was anticipated. I was thinking they should have been more than was anticipated due to how long we waited!!!

    I called today and they was able to tell me the amount I was going to receive. So the checks are printed and going out. Watch the mail everyone.

      Haven’t got mine either. Was told I needed info for taxes, which I gave the lady iver the phone. Then I got the same questions in the mail that the lady asked me on the phone, filled that out. Called, and they told me April, now tomorrow is august. Where is my check?

    Now its nearing the end of June. I havent got a postcard or an update. This is the only forum that somewhat gives an update to what is going on. Has anyone received any news?

      We were told you can call in the beginning of August to get an amount of what will be on your check and we will have our checks by the end of August.

          Exactly,they keep messing us around. Ridiculous. Haven’t heard a thing. They have been telling us since Jan. that they will be sent out each month.
