Volkswagen class action lawsuit overview:

  • Who: Four consumers filed a class action lawsuit against Volkswagen Group of America Inc., Audi of America Inc., and their parent companies.
  • Why: The plaintiffs claim certain Volkswagen and Audi vehicles have defective engines that consume excessive oil.
  • Where: The class action lawsuit was filed in New Jersey federal court.

A new class action lawsuit alleges Volkswagen and Audi vehicles equipped with a certain engine have a defect that causes excessive oil consumption.

Plaintiffs Lauren Reece, Margaret Ponder, Diana Ferrara and Loretta Moutra claim Volkswagen and Audi vehicles equipped with the EA888 2.0-liter TSI engine have an oil consumption defect that causes carbon buildup.

The plaintiffs claim the carbon buildup causes the positive crankcase ventilation (PCV) valve to stick, resulting in crankcase overpressurization that damages seals and expands and cracks the plastic oil pan cover, resulting in substantial oil leaks and consumption.

“Had Plaintiffs and the other Class Members known about the Defect, they would not have purchased or leased the Class Vehicles or would have paid substantially less for them,” the Volkswagen class action says.

Volkswagen, Audi refuse to honor warranties, plaintiffs claim

The plaintiffs argue the defect is covered by Volkswagen and Audi’s warranties, however the automakers refuse to honor the warranties.

“Moreover, Defendants have not released or made freely available a countermeasure that adequately fixes the Defect, including more robust piston rings,” the Volkswagen class action says.

They want to represent a nationwide class and state subclasses of consumers who purchased or leased a Volkswagen or Audi vehicle equipped with the EA888 2.0-liter TSI engine.

The plaintiffs claim Volkswagen and Audi are guilty of breach of express and implied warranties, fraudulent omission and violations of state consumer protection statutes.

They demand a jury trial and request declaratory and injunctive relief and an award of compensatory, exemplary, statutory and punitive damages for themselves and all class members.

Recently, Volkswagen recalled 356,000 Audi vehicles due to a software error that may prevent the rearview camera image from displaying correctly.

    We purchased a 2016 Jetta and had constant issues especially with oil. Required monthly oil changes and “top offs” throughout the month despite being told we had no leaks or problems. I have thousands of dollars worth of receipts proving the issues we had due to this problem

    I have bought my 21’ Tiguan brand new never had any issues with it until my warranty was done. I have issues with pressure. Roughly 2 years ago, my oil pan kept cracking. No matter how much I changed it or switched it out. Within a week, its cracked again. Come to find out my PCV, and other components has to be replaced. Fast forward to today, still having pressure issues. Now it’s my water pump and upper timing cover that needs to be replaced. Love my car but tired of these pressure issues. I’ve been to two different VW dealerships and nobody can explain how to get rid of the pressure issues.

    We purchased a 2023 VW Tiguan new, in December of 2023. We recieve regular 10k miles service. We have had excessive oil burn starting around 30,000 mies, which required oil top offs. We did contact the dealer (who is now out of busines), they denied that there should be that issue and that we weren’t due for an oil change for another 5,000 miles. We did get the oil topped off else where. The check engine light came on around 59,000 miles and was brought into the dealership on April 7,2026. It was determined that the water auxillary pump was damaged and in need of replacement, which was covered under our extended warranty. It was also determined that our cylinder head ports needed to be cleaned due to our excessive oil build up/residue and this is not covered under the extended warranty. They further states that this was unrelated to the water auxillary pump being damaged, which wiuld covered the cleaning under our extended warranty. The dealership wants to charge us $5,000 for the cleaning. We were advised by VW customer care to take it to a different dealer to get a second opinion. We will be doing this on Monday. The issue of the excessive oil burn has been documented and states that some of the problems this can cause is a faulty water auxillary pump, which can lead to the build up carbon and oil residue. We have an appointment at a second dealership on Monday. So far we are out $200 for the diagnostic fee and at this current moment in need of an alleged $5,000 in repair. Which everyone states is a known problem. Please include in the class action lawsuit.

    Currently have a 2018 Tiguan (93k) with the same issues. Today received a quote for $7k to replace the cylinder head. Which may or may not solve the issue, after I already paid $800 for an oil separator 1,515 miles ago.

    2017 Tiguan that actually ran out of oil. WTF? Had to pull over and walk to a 7-11 to get oil so I could get home after work. Crazy thing is the check engine oil light NEVER came on!!! Was a good car, but glad I got rid of it. Just amazing at the oil consumption of this car. You just couldn’t tell this motor at 125,000 miles that it had any other issues other than the oil leak.
