Vibgram FiveFingers shoesTop Class Actions viewers are starting to receive checks in the mail from a class action settlement stemming over claims that Vibram USA Inc. misrepresented the benefits of its FiveFingers footwear.

According to comments and posts on the Top Class Actions Facebook page, Class Members who submitted timely and valid claims for the Vibram FiveFingers settlement began receiving checks worth as much as $20.21 on June 15, 2016.

The Vibram class action settlement resolves allegations that the footwear manufacturer falsely advertised its FiveFingers running shoes as having certain health benefits including:

  • Improved posture
  • Reduced risk of injury
  • Muscle strengthening

According to the plaintiffs, certain Vibram FiveFingers actually increase the risk of injury because the shoes alter the way consumers run.

Vibram denied the allegations but agreed to settle for $3.75 million to avoid the risk of further litigation.

Class Members of the Vibram FiveFingers settlement include consumers who bought eligible FiveFingers footwear in the U.S. between Mar. 21, 2008 and May 27, 2014.

The deadline to file a Claim for the Vibram settlement passed on Sept. 24, 2014.

    I filed a claim sometime in 2014 and have not received any check either. Was this a fraud? I even still have my claim number.

    I filed a claim as well several years ago and never received a check. I see the website is dead, has anybody had any luck tracking down payment? Thank you!

    I filed my claim in June of 2014. Never received a check. The settlement website no longer exists. The phone number on my claim form takes you to a recording saying checks should have been received by June 22, 2016. At this point only discussion forums like this can provide any semblance of information on this settlement.

    I finally received a Settlement Check by USPS on 02/09/2017. The check was issued 3 weeks earlier, on 01/20/2017. The notice indicated that I only had until 02/04/2017 to cash it or negotiate it.

    Heffler, Radetich & Saitta, LLP only allowed me 2 weeks to respond and there is no indication that they mailed the check within that time frame.

    Furthermore, my Claim was for (2) pairs of Vibram Five-Fingers and the check was only for $10.11 (the amount for one pair).

    This entire Class Action Suit appears to be a scam by H,R&S LLC, to falsely claim to respresent owners of the Vibram Five-Fingers when in actuality, this Law Firm has made no real effort to pay the Award to the Claimants.

    I will be pursuing this with the AG of PA.

    There has to be more individuals like myself who followed all the rules and are getting shafted by this Law Firm.

      I’m with you on this I never received my checks and I know Crest my T’s and dotting my I’s I think that there must be action to take when you are part of a lawsuit and do not get compensated legally. This indicates that there is a complete and total acceptance of fraud within our judicial system which needs to be amended there are so many different lawsuits I have participated in and simply because I have used these products or a been affected by such products where is our legal rights to defend ourselves against those who do not pay the money to supposed to end where does that money end up going.?

    Is there any law enforcement organization that monitors this type of failure to pay the settlements to Class Action members?

    The more research I do the more it appears there has been many instances of failure to pay on the Vibram Class Action.

    Based on my own personal experience, which includes numerous attempts on my part to communicate with the Claim Administrator by telephone and website “Contact Us” pages, and their refusal to ever respond, it certainly appears they have every intention of stealing my settlement.

    Who do I turn to?
    The Attorney General?

    So I submitted this Contact Us page with complete details of Claim number and that it was the Vibram Five Fingers Class action.

    I received an actual email response a few minutes later asking which class action I was involved in…even though it was clearly identified in my original message.

    I attempted to respond to that email and received a notice it does not accept incoming mail.

    This lawsuit has been quite time consuming and it almost seems intentionally difficult to receive our settlement.

    How many other claimants are not getting paid? Is there fraud involved here?

    Update:

    I called the Claim Department at the number I provided in the last comment and was informed there is no record that a check was ever mailed to me after I provided them my Claim Number.

    They have promised to research this failure and phone me with the results of their internal investigation.

    I do have all of the documentation which proves I filed my original claim prior to the deadline.
