SunRun Deceptive Marketing Class Action Lawsuit

By Matt O’Donnell

SunRun Inc.SunRun Inc. has been hit with a class action lawsuit alleging the San-Francisco-based solar energy company deceived consumers into leasing SunRun solar panels by making misleading claims about their cost savings and about the increasing costs of electricity.

Plaintiff Shaw Reed alleges in the SunRun class action lawsuit that the company misled consumers into believing they could save money on “rising electricity costs” by using SunRun solar panels despite the fact that the energy prices at Southern California Edison began dipping or plateauing after 2008.

“The central premise of SunRun’s uniform marketing campaign is that increases in electricity prices will result in cost savings by installing the SunRun Solar system,” Reed says in the SunRun class action lawsuit. “But SunRun deceptively states with certainty something that is inherently unknowable.”

Reed further alleges in the SunRun class action lawsuit that the company was operating without a business license from 2007 to February 2012. The class action lawsuit is seeking a refund on customer fees from contracts entered into before 2012.

The SunRun class action lawsuit also claims company agents misleadingly told consumers they could terminate their SunRun contracts if they move.

The SunRun class action lawsuit is brought on behalf of all persons and entities in the state of California who entered into a solar power contract with SunRun prior to February 2012. It is also seeking to represent a subclass of all Class Members who were told by SunRun that they could terminate their contracts without further obligation if they moved.

The SunRun Class Action Lawsuit case is Shawn Reed v. SunRun Inc., Case No. BC498002, Superior Court of the State of California, County of Los Angeles.

        1. Rubina says:

I would like to join the lawsuit. I just got solar panels, not up and running and they’re already billing me for the loan. Plus I’m paying SCE because the panels are not up and running. I started in August installed in October and now December and still not active. No response from anyone within 2 weeks.

        2. Elizabeth Griffiths says:

  4. Patricia Yancey says:

I just received tru up bill from PG&E for $1400.00 + yet I have been under the certainty that Sun Run was going to absorb any additional cost and if I did not have enough panels more would be put on the roof. It took me a year to go forward with installing solar and only did after the assurance of no end of the year tru up bill. I am at a loss. I don’t have that kind of money just sitting around.

    1. Stacie Frederick says:

We are looking into joining a class action lawsuit against Sunrun! We received our tru bill of $6000 from the electric company SDGE!! we have a written statement from SDG&E that our solar panels do not appear to be running properly. I have had the worst run around with sunrun that I’ve ever experienced with a company! and they refuse to take any steps towards providing us with any compensation. We have been cheated out of $25,000!! Our electric Has significantly increased three times the amount we were paying for electric without solar! And on top of a very expensive electric bill we also we’re paying $250 a month to Sunrun! that came out to $750 a month. The customer service is horrific!!! I cannot tell you how terrible this experience has been to our family! They will be turning off our electricity within a weeks time. And Sunrun has advised us to pay our $6000 bill because they will not compensate us and WILL NOT MAKE ANY ATTEMPT TO acknowledge the written report and statement from the electric company in regards to their solar panels is not working properly. This is a true financial tragedy for our family! And I will do everything I can to stop other consumers from Sunrun cheating them! The rich get richer and we get Screwed!

      1. Willet Cendana says:

How do you file class action. I have the same true up bill

      2. Swift says:

May I suggest you log in to the sunrun app for your solar panels and see if they are operating. The utilities lie.

    2. Larry says:

I wonder if the Class Action lawsuit is still continuing. I would love to join it to reveal the true nature of Sunrun, which traps customers into contacts and then treats them like dirt. Terrible company!

    3. Larry says:

I wonder if the Class Action lawsuit is still continuing. I would love to join it to reveal the true nature of Sunrun, which traps customers into contacts and then treats them like dirt. Hope the lawsuit continue.

      1. Rosalinda Delacruz says:

I would like to join I had a representative come to my door told me I could put 8 more panels and my payment would drop instead I pay more than a light bill payment during summer and still have a payment from my light bill. I never signed for the work to be done on paper when they put the extra eight panels I was not home. So install waa not done the day they came I was never given any paperwork to sign. For install. My original panels I had them put on by viviant then sun run took over. They are deceieptive. Why would anyone want to pay more than they can afford.

  5. Bouseh says:

How do I join this class action?

  6. Jeff Turpin says:

We are having the same issue. We we told that is was a 10 year lease but on the last pages it says 20 years. It was worded strange and we missed it. If the were upfront and truthful we never would have agreed to a 20 years lease. Argggg

    1. Peggy Kight says:

Whitaker law has a class action lawsuit against them. Go to that website

  7. Rubin says:

We have all the same issues too. We pay a monthly fee to Sunrun and then they say we over produced and Bill us for more. We still have to pay Edison at the end of the year. We have not saved any money having our solar panels. We even got extra panels to run our jacuzzi which we never used and still have to pay. All this misrepresentation is horrible and not fair. You are shown one thing and told another. We were told they will come out and clean the panels and we have had them over 5 years and no one has come. We even asked about buying the system as we were told by the sales rep and it showed the prices in our paperwork and Sunrun told us that is not the total price. Total ripoff. We Did tell them to come take them off and they replied, we are not in the business to come and remove them after installing and we say, we are not in the business to be taken advantage by crooks either.

    1. Mary says:

I was told by sun I have zero deposit zero lease no money needdd that the government will pay for all of it sounds too good to be true

    2. Gayle Davis says:

I have the same issue. They will not come and clean panel’s. We were lied to and deceived.

  8. Dan Walker says:

Does anyone have a status on this class action law suite?

I also entered into a contract before 2012 and was scammed.

    Thanks,
    Dan

  9. Dino Balgemino says:

all the while i thought that “over-production” of these panels equate to banked electricity credited to our account…at least that was how it was explained to me by the representative of Verengo.

he explained that “net-metering” meant any overproduction basically meant reversing the charge of the electric company, which could mean lower charges from them. i actually don’t see any summary in the billings of Sunrun…how do you know if total committed production of the panels are achieved at all?

    Dino

  10. Mandy Delaney says:

We should. All get together and start a class action even if it means finding a different attorney if this one is to busy or unwilling sunrun/verengo is owned by Edison under all kinds of subsidiaries which is more then just deceptive business practices it’s also ussery in the sense that they’re technically double-billing their billing us for having the solar panels that they get the power from. their billing us for using the power that they get off the solar panels that they have on our homes. so they’re using us to get the power and then making us pay to use the power that they’re getting from the use of our own homes ,power that they get from panels that they from the panels we pay for. So basically we’re paying to have the panels but they get the power and then we have to pay a second time to get the power that came off the panels that we paid for their double charging us and that’s more than just deceptive
