SunRun Deceptive Marketing Class Action Lawsuit

SunRun Inc.SunRun Inc. has been hit with a class action lawsuit alleging the San-Francisco-based solar energy company deceived consumers into leasing SunRun solar panels by making misleading claims about their cost savings and about the increasing costs of electricity.

Plaintiff Shaw Reed alleges in the SunRun class action lawsuit that the company misled consumers into believing they could save money on “rising electricity costs” by using SunRun solar panels despite the fact that the energy prices at Southern California Edison began dipping or plateauing after 2008.

“The central premise of SunRun’s uniform marketing campaign is that increases in electricity prices will result in cost savings by installing the SunRun Solar system,” Reed says in the SunRun class action lawsuit. “But SunRun deceptively states with certainty something that is inherently unknowable.”

Reed further alleges in the SunRun class action lawsuit that the company was operating without a business license from 2007 to February 2012. The class action lawsuit is seeking a refund on customer fees from contracts entered into before 2012.

The SunRun class action lawsuit also claims company agents misleadingly told consumers they could terminate their SunRun contracts if they move.

The SunRun class action lawsuit is brought on behalf of all persons and entities in the state of California who entered into a solar power contract with SunRun prior to February 2012. It is also seeking to represent a subclass of all Class Members who were told by SunRun that they could terminate their contracts without further obligation if they moved.

The SunRun Class Action Lawsuit case is Shawn Reed v. SunRun Inc., Case No. BC498002, Superior Court of the State of California, County of Los Angeles.


UPDATE 6/29/13: A federal judge has refused to dismiss the SunRun Deceptive Marketing Class Action Lawsuit, allowing it to move forward.

    We purchased a home in Surprise AZ and did a lease transfer from SunRun. There are no savings – APS bill was $170.00 last month and SunRun lease is $130.00. Its obvious that the panels were not installed correctly as they are not working! I’ve been told that SunRun left Arizona due to the mass number of complaints. Who do I talk too?

    I started with Vivint solar around 8 years ago. Sunrun bought Vivint. I was totally lied to by the salesman about the savings I would realize. I told him to put it in writing, I received an email with links that are now invalid. I’m not saving what was promised, in fact I’m actually paying MORE per kWH of electric now.
    And now I need a new roof. Sunrun sent me a remove/replace quote for the panels for $3,200 ! Original contract with Vivint shows $499 to remove/replace the panels. When I showed their customer service that original quote they then sent me another quote for $3,200. I questioned that and they said “don’t worry, you will only be billed $499”. Do they think I’m an idiot and would sign this??? I told them to send a quote showing only $499 and they have not responded. Sunrun is a horrible company and do nothing but scam their customers.
    I need a lawyer to break this lease. Does anyone out there know of a lawyer that has experience with breaking a lease with Sunrun? I’m willing to pay for this service.

    We are in need of a new roof. We were told over 10 years ago from sunrun we didn’t need a roof,but we did and they lied to us about how much we were going to pay a month also.

    We purchased our panels in 2011. We have never seen any savings, never had credit in our utility bank with PSEG. I have done multiple analysis with usage bills to show my 16 panels are not working up to their contract., sent photos , have had service calls when the panel reads errors .
    Now after 12 plus years they want to give me 27 more panels (after I was told I had the max I could fit) & a battery backup for $233 a month for 25 years totaling over $69,000. Totally unacceptable and would like an answer and money back for my outlay of the purchase and the loss of what my bills should have been with correct solar panels !

    We have also had NO SAVINGS since installed in 2017. We have 44 panels and we have not had a savings month to date. We just had loose wires that were installed with the solar that have been slowly burning and detaching from the bolts of the electric meter box. Our electric starting arcing and could’ve exploded our electrical system if our power company didn’t cut our power. The wires that have been burning are the same size and age coming from the solar equipment to our main electrical panel. We have have been displaced from our home for a week. Sunrun refuses to accept any responsibility at all.
    We also had an underperformance message from our panels to Sunrun in 06/27/23 and didn’t get a technician to solve the issue until 4/25/23. The technicians disconnected the panels to prevent the underperformance message going to Sunrun. They said they’d come back with new panels and reconnect but never did. Our system is a 20-year lease. They want to charge me $190 for a technician to look at the disconnected panels because all their systems say our system is running correctly. Even though I submitted a written statement from a local solar contractor saying we are down 16 panels out of 44 total panels. Solar is supposed to be working at 95% capacity. Their computer equipment assessing our system is inaccurate. This company promised we would see savings immediately and we are still waiting! Now we have $3,500 in electrical repair costs that are directly to our faulty solar install by Sunrun.

    I was also duped. I was told I would have enough panels that I would save money, I’m not. I’ve had them for one year and I want out! I’ve told I can’t even try to get rid of them for 5 years and then I have to buy the system. I was told my bill with Sunrun would stay the same for 25 years. I just got my annual rate increase and that will happen every year. I listened and believed them just to find out there’s a little line where they can increase me every year. My true up was over $500 and that was with me paying every month to PG&E on top of my Sunrun bill.

    I would like to file a lawsuit against Sun Run Solar Company. Since we acquired our home 3 years ago and have acquired the lease agreement from previous owner, we have had so many issues with our solar. Last year alone, they have credit our account almost a years worth of payment because of the issues with the solar. Most recently, they were suppose to replace 8 panels was not ordered until 2 weeks after the technician left our home. It was only ordered because we followed up. Then they said it would take 60 days which we got them to expedite that replacement, but even when it was replaced the panels were not working. We are already going into the fall season and we have missed all summer getting a full potential of earning solar. Today, they were suppose to come to replace the inverter panel, and no one called us to say that the shipping was delayed.

    Please help us all , we are in need. your help . Since we have sunrun install a panel on top of my roof last year , it wasn’t producing enough energy for 6 months till one of the technician come to check and he said who ever install it wasn’t turn on and I should get a refund for all the months that I wasn’t working . So we start calling them to refund us the money . But ask me for my 1 year pseg electric bills so we did send priority mail of course after all most one month no response when I call them one of the customer service said the case is close . So he ask me to do the same thing again and my son did , my bills in electric is more than $300 and plus sunrun is $259 monthly , I didn’t expect this much it double up my monthly bill . I told them I’m not savings any money . I told them to take the panel on my roof coz of my I wasn’t satisfied of the service . They even mention to cut the tree both side of my house and front .so I said what I don’t have money for that. Since that time no body come to check again . I spoke to a supervisor she said they can’t refund my money coz they give me $111 credit , I said that’s it , now they want to work something with me . Hope someone can help us

      I’m in NJ and I have also been lied to! If anyone has info on a lawsuit or anything about having system taken off my roof please contact me? I have also asked 5 times for a yearly comparison between my electric bills and Sunrun. Each time I tried to contact them about it they never received my electric bills, case is closed, someone will get back to and so on. Sunrun also changed the blueprints at the last minute and I believe they used my electronic signature to make it look like I approved the change. They deleted 1/3rd of the panels they originally told me I would get on the original blueprints and contract. They said I would be making too much electricity!!! I have also just summited my second Water Leak Issue. They never paid me for the first paint repairs! How can a company do these things and their is nothing for us to do? Thank you my Government!

    Sunrun and their salesperson promised us that we would be saving money and gaining money by installing solar panels to generate electricity. However, we are not only paying way more money with the solar panel lease but also, still paying electricity bills. This is definitely a scam. I contacted Sunrun and they said you can cancel it after 5 years but still have to pay the rest of the lease in full. Please help!

    We are also duped by the Sunrun people. Told we have MAXIMUM amount of panels. NOT ! We have 28! We are not getting the savings we were promised. I want them off my roof or tuned in to give me the savings I was promised.

      We are experiencing the same issues. 800 dollar local electric company bill with a 400 dollar sunrun leasing bill. $1200 a month on just electric. That’s crazy!
