Secretlab discounts class action lawsuit overview: 

  • Who: Sean Nugent filed a class action lawsuit against Secretlab US Inc. 
  • Why: Nugent claims Secretlab inflates the original sales price of its Secretlab Gaming Chairs online in order to offer discounts that appear greater than they actually are. 
  • Where: The class action lawsuit was filed in California federal court.    

Secretlab US inflates the original price of its Secretlab Gaming Chairs in order to present online discounts that appear to be a greater value than they actually are, a new class action lawsuit alleges. 

Plaintiff Sean Nugent claims Secretlab Gaming Chairs sold on Secretlab’s website have a listed original price that they were either never actually sold at or only sold at for an “inconsequential period of time.” 

Nugent argues the “false discounts” offered by Secretlab are an illegal marketing tactic used to “convince” consumers that they are getting a big discount and should make a purchase before the item “goes back to its original price.” 

“This practice is consistent across the Products sold by Secretlab, and Secretlab continued to engage in this deceptive marketing practice for years,” states the Secretlab class action. 

Nugent wants to represent a California class and California consumer subclass of individuals who have purchased a Secretlab Gaming Chair within the applicable statute of limitations period. 

Consumers expect Secretlab to be ‘honest,’ ‘forthright,’ says class action

As one of the “leading gaming chair retailers in the U.S., consumers expect Secretlab to be “honest and forthright in its advertising and marketing of its products,” according to the Secretlab class action. 

“Despite this trust, Defendant has engaged in false and deceptive advertising in the marketing and sale of the Products,” states the Secretlab class action. 

Nugent claims Secretlab is guilty of common law fraud and in violation of California’s Unfair Competition Law, False Advertising Law, and Consumers Legal Remedies Act

Plaintiff is demanding a jury trial and requesting declaratory relief along with an award of economic, monetary, actual, consequential, compensatory, punitive, nominal, and statutory damages for himself and all class members. 

A similar class action lawsuit was filed against Spokeo in October by a consumer arguing the company advertises false discounts on its website in order to entice potential customers to make a purchase.

    I went to buy one last night, and the banner said $100 off, with the chair I wanted directly underneath it. I was informed via chat that it was only $30 off. and that the amount off depends on the model and material. That the chair with $100 off is the chair with the upholstery for the Fortnight Battle Bus! Yikes! I asked to speak to a supervisor and was told no. I said it was a bait and switch and I asked about 4 or 5 times for a supervisor and was told no.
