The Claims Administrator for the Cobell v. Salazar Indian Trust class action settlement has announced that the second round of payments will be mailed early next year.
The announcement further stated that the settlement approved by Congress and the Courts “requires identification of all Trust Administration Class Members and calculation of their respective shares by the Department of Interior” before The Garden City Group (GCG), the Claims Administrator assigned to distribute benefits, can start mailing Trust Administration Class payments. This task is near completion, according to the announcement.
After Class Members are identified and finalized, it will take the Department of Interior approximately a month to complete the calculations for the over 500,000 Trust Administration Class Members. Once GCG receives the final computations and the Court approves, the Claims Administrator will “quickly prepare and commence distribution within three weeks.”
If the class membership is determined this December, the payments can then be made in the first quarter of 2014 barring any unexpected issues.
The Cobell v. Salazar settlement was one of the largest class actions ever filed against the United States. It accused the government of allegedly mismanaging money owed to Native Americans under trust funds. The alleged mismanagement dated as far back as the 1880s. The first payments were sent out last December 2012 before Christmas.
The Indian trust class action lawsuit was originally settled in December 2009 and later approved by Congress in November 2010. An appeal was filed and the case was held up in court for nearly two years. In May 2012, an appeals court rejected the appeal and upheld the $3.4 billion Indian trust settlement as fair, reasonable and adequate. On Dec. 12, 2012, the court filed an order directing the Claims Administrator to commence distribution of payments to Class Members no later than Dec. 24, 2012.
The class action settlement provided $1.4 billion to pay recipients listed under the Historical Accounting Class and the Trust Administration Class, $1.9 billion to purchase fractionated individual Indian trust lands and up to $60 million for a scholarship fund to help Native Americans attend college or vocational school.
Reports state there are 34,786 Navajo allottees listed in the Trust Administration Class who will split $49.5 million for this second round of payments. Each one will receive $800 but may be higher for some.

You’re right! They are holding the pymt while they make a fortune in interest at our expense again. The interest should go to the people. This entire case was to screw native people who own any type of mineral land, oil rights and profitable land that the government (BIA, DOI, BLM, MMS, etc) did not do their jobs and protect the Rights of these people, so NOW they can NEVER sue the government and get back the millions of dollars that were STOLEN from them due to the gov. and tribal council members along with the mining companies who ALL had their hands in the pie and they all got away with it thanks to this unfortunate case and now all of our Rights are gone over a few measly dollars that don’t even come close to compensating for the stolen millions. The government is getting away with screwing Native American’s AGAIN!

Wow some type of government we have first off they come at us and try to make us feel,good and say wer’e gonna recieve our check’s the first quarter of 2014 or early 2014 and they go and tell us that they have no time frame of when the second phase of our checks,aregoing to be mailed and the so called garden city group keeps telling us our whole amount that we are supose to get and they keep saying it’s just an estimate why are these idiot’s handling our money if they just kesp saying that its just an estimate but when we get our checks we might not gst the whole amount come on maybe the garden city group is making money off of us
yes, again this is screwing! Now that they have everyone stuck, they have signatures and deadlines have passed…..they can hold that money until hell freezes over and collect mass interest, pymts for their services and we will end up with probably about half of their “puny ESTIMATED” check amount. This is so wrong and such an injustice to the Native people. They got away with a huge screwing and now we have NO Rights…..the bottem line of this whole entire case was to keep the people who are owed millions for the cheating and stealing that the gov., did to these people and they wanted to make sure that NO ONE could sue them and get their money back that is owed to them and didn’t want the gov exposed to the public on how many did not do their jobs and look out for the Rights of the tribal member and didn’t want names exposed of the crooked gov employees who live high on the hog from stealing from the nieve native american who trusted the BIA and DOI to look out for them. That’s the reson for these agencies being put into place in the first place. FAILED US GREATLY!

its funny keith harper and his lawyer group get $99 million out of the settlement already paid out, and another $14 million still pending the judge for fee’s and The thousands of elders can’t even get a measley $800 check. my my my send me to the Ukraine!!!
This trick is called “slight of hand” If it was going to take this long, it would have been better if we went for the larger payout. Billions. We all thought this way would be quicker, by my est. we should have waited. People read the past treaties, do you think they’ll ever change, still the same families from a 200 years ago still in the Gov.
Never believe it until the check is in my hand. I never trust any thing that any goverment promises on any thing. They like to take their time just to#screw us.
