Ruggable class action lawsuit overview:

A new class action lawsuit accuses Ruggable of sending marketing text messages outside of the hours allowed under the Telephone Consumer Protection Act.

Plaintiff Kaitlyn Guthre claims Ruggable sent her marketing text messages at 6:01 a.m. and 6:02 a.m. between Oct. 2 and Oct. 12, 2025. The TCPA prohibits telemarketing calls and texts between the hours of 9 p.m. and 8 a.m.

Guthre says she never signed any type of authorization permitting Ruggable to send her marketing text messages before 8 a.m. or after 9 p.m.

She filed the Ruggable class action lawsuit on behalf of herself and a proposed class of consumers in the United States who received more than one marketing text message from Ruggable within any 12-month period where the text messages were initiated before 8 a.m. or after 9 p.m.

Consumers entitled to up to $1,500 per marketing text message

The TCPA affords special protections for consumers who receive marketing calls and text messages before 8 a.m. or after 9 p.m., Guthre says.

Consumers who receive more than one call or text during these violative hours are entitled to recover a penalty of up to $500 per call or text and up to $1,500 if the TCPA is willfully or knowingly violated.

Guthre says Ruggable’s unlawful conduct resulted in intrusion into the peace and quiet in a realm that is private and personal to her and the proposed class members.

Guthre is seeking an order certifying the Ruggable class action, an award of statutory damages for herself and each class member, an injunction requiring Ruggable to comply with the TCPA and an award of attorney’s fees, costs and interest.

Currently, tech manufacturer Lenovo is facing a lawsuit for sending text messages before 8 a.m. and after 9 p.m., also in violation of the TCPA.
