- Where: The class action lawsuit was filed in California federal court.
A new class action lawsuit alleges Lenovo United States Inc. sent marketing text messages to consumers at unlawful hours.
Plaintiff Peejay Reyes claims Lenovo sent him two marketing text messages before 8 a.m. and after 9 p.m., in violation of the Telephone Consumer Protection Act (TCPA).
Reyes argues the TCPA provides special protections for consumers who receive marketing calls or texts before 8 a.m. or after 9 p.m. “The problem with receiving unwanted telemarketing communications is a problem that most people in this country, like Plaintiff, frequently face,” the Lenovo class action says.
Reyes wants to represent a nationwide class of consumers who received more than one marketing text message from Lenovo before 8 a.m. or after 9 p.m. in any 12-month period.
Lenovo’s marketing text messages advertised goods, services, class action says
Reyes claims Lenovo sent him the marketing text messages on Nov. 28, 2025, and Dec. 1, 2025, at 6:48 a.m. and 8:58 a.m., respectively, and argues the messages were an intrusion into his peace and quiet in a realm that is private and personal to him.
Further, Reyes argues Lenovo violated the TCPA and its implementing regulations, which prohibit the initiation of telephone solicitations to residential telephone subscribers before 8 a.m. and after 9 p.m.
“The purpose of Defendant’s telephonic solicitations was to advertise, promote, and/or market Defendant’s property, goods, and/or services,” the Lenovo class action lawsuit says.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages for himself and all class members.
A separate lawsuit filed against Lenovo in February claims the company shared the data of consumers in the United States with China.
