Nissan A federal class action lawsuit claims Nissan knowingly sold certain Maxima, Altima and Quest vehicles equipped with defective automatic transmissions that can suddenly and unexpectedly fail while being driven.

According to the Nissan transmission defect class action lawsuit, the allegedly defective transmissions are present in 2004-2006 Nissan Maximas, 2005-2006 Nissan Altimas, and 2004-2007 Nissan Quests. The class action lawsuit claims Nissan knew, or should have known, since at least 2004 that the automatic transmissions in these vehicles are defective, which can cause them to break down prematurely; experience transmission slips, delayed shifts, and acceleration surging; and suffer mechanical failure.

Rather than alerting consumers about this safety hazard and offering to repair the vehicles, “Nissan has concealed this problem from its customers at the time of purchase or lease and thereafter,” the class action lawsuit states. Not only has this put consumers in danger, but it has also allowed Nissan to profit from the defect by selling replacement parts to Class Members.

The Nissan transmission defect class action lawsuit is brought on behalf of all U.S. consumers who purchased or leased any 2004 through 2006 Maxima, 2005 through 2006 Altima, or 2004 through 2007 Quest vehicle equipped with an automatic transmission. It is seeking class certification, damages, disgorgement of profits, and injunctive relief.

The case is Howard Teba v. Nissan North America, Inc. and Nissan Motor Company, Ltd., Case No. 12-cv-00332, U.S. District Court, Central District of California, Western Division.

UPDATE: This case was voluntarily dismissed by the plaintiff on June 29, 2012. Details behind the dismissal were not indicated in court documents.

    I have a 2008 Nissan Altima and my car is doing the exact same thing. That many of you guys are talking about. I would like to be added to the class action lawsuit as well.

    2012 nissan rogue bought it new. After driving for around 2000 mile cvt transmission start filling like frastration. Humming noise vibration and tranny slips. after drove it for 16000 mile could not handle this pain and listened to a nissan sales person and traded in 2014 rouge sl. There i made mistake buying a nissan for second time. 2014 looks great but performance same like last model. This time not only transmission, break master cylinder replaced, in rainy day when turn my steering wheel right to center a noise comes from right side that they said it normal. 2014 rogue drove it for 15000 mile and traded for a toyota.
    Wasted a lot of money by trying nissan and i regret for that. I will tell all not to buy nissan cars. They may appear fancy but you will end up buying trouble and if you can not handle it then good luck when you want to trade in.
    Better stay away from nissan cars with cvt transmission.

    I have a 2015 Pathfinder(bought it new), we went out to dinner, when we got to the car we noticed that the car was running. We knew we turned it off. (When I bought this I just wanted the basics, no bells and whistles, it’s just more stuff to go wrong with the vehicle.) I unlocked the car, the lights on the dash and the radio was off. I turned off the car and restarted, the lights on the dash and radio came on.
    I know something wasn’t right and we DID turn off the car or I would have heard the radio. We already have two recalls on this vehicle. So sad they don’t make cars like they use too and take pride in their work, they just throw those cars out.

    I have a 2005 Nissan Altima, same transmission issues as basically “everyone” else..can anything be done..or are we just completely screwed?? If anyone has an update or knows of a “OPEN” class action that has not been dismissed please let me know my email is awhittakerlpn@yahoo.com if you send anything post ALTIMA CLASSACTION IN SUBJECT so I know it’s not junk! Thanks so much! Any help is greatly appreciated!

    I have a 2007 Nissan Quest SE, my tansmission sometimes bangs so hard when driving like someone hit me. We have transmission fluid changed within the year and a mechanic said it needs to be changed already. Motor mounts have to be replaced and all this is expensive to fix. Nissan should be fixing all this stuff.

    My daughter has a 2011 Nissan Maxima with the CVT transmission in it. It is slipping bad. We’re getting ready to get a used transmission to put in it. The car has 93,000 miles on it. She has called Nissan Consumer affairs with no help from them. She has a case number with them for what ever that’s worth.

    I have 2006 Nissan Maxima SE with the automatic transmission, at 135xxx miles currently. It slips and jerks between all gears, and I am worried it will give out at the wrong time i.e. Trying to merge on to the highway! This website shows the lawsuit has been dismissed? Either way I would like to be added to it, or know what has come of it because these are trash transmission. Never seen anything like this, they should be recalled. If I can be added, or get some sort of update that would be great. Thank you

    So disgusting how Nissan is manipulating with greed and not owning a major problem with a life and death potential issue. My transmission had to be replaced in my 2004 Nissan Maxima – cost me 3,500 for a transmission at around 70,000 miles. Right after I nearly got killed with my car slowing down in fast rush hour traffic and jerking all over the place. I called Nissan about the transmission issue – heard they had knowledge of the faulty transmissions with my model and was told they had not heard anything at all – no complaints…right, how could they not know with hundreds of complaints I was seeing all over the web. They are equivalent to someone causing a massive catastrophic disaster on innocent people, trusting them with purchasing a car from them – and instead of paying for the damage they have allowed to go on – they look the other way and act as if nothing is going on…I still have the car and I want justice…they need to pay up – if they can afford to ignore a hazard that could not only kill the person in the car but surrounding cars , they should pay to help people impacted…the entire situation and all the people impacted is plain sadistic for a company to know about it and do absolutely nothing.

    I have a Nissan Quest 2007 3.5 S 5 speed transmission. Transmission is giving problem badly and repair cost is 2500$. Surly never ever bye Nissan Quest again after the painful time.

    As I review all the complaints regarding the 2006 Maxima, I have experienced the same problems. I contacted Nissan North America and was told that my VIN didn’t fall into the recall. WTH, that is not what the article reads, it states 2002-2006 Nissan Maxima. I was then told to take to a Dealership for a diagnosis, which I will probably have to pay for. Once the diagnosis is complete to determine what cause the transmission to go out, then the issue would be escalated. I nearly got killed due to the car not picking up speed and jerking as if I was just learning how to drive a standard shift, because of all of this an Semi-Truck almost whipped me out. It is sad that Nissan will not own up to this issue, I could see if I was asking for a new vehicle, but I just want my car repaired.

      It’s actually a faulty transmission valve body which controls the fluid the goes through the converter which In turn goes to the transmission you can get a reman valve body for around $300 and they are pretty easy to put in cost me about $500 total to have my replaced in my 06 Altima and they corrected the problems in the valves when remade re4fo4a is the model of valve body
