Nissan A federal class action lawsuit claims Nissan knowingly sold certain Maxima, Altima and Quest vehicles equipped with defective automatic transmissions that can suddenly and unexpectedly fail while being driven.

According to the Nissan transmission defect class action lawsuit, the allegedly defective transmissions are present in 2004-2006 Nissan Maximas, 2005-2006 Nissan Altimas, and 2004-2007 Nissan Quests. The class action lawsuit claims Nissan knew, or should have known, since at least 2004 that the automatic transmissions in these vehicles are defective, which can cause them to break down prematurely; experience transmission slips, delayed shifts, and acceleration surging; and suffer mechanical failure.

Rather than alerting consumers about this safety hazard and offering to repair the vehicles, “Nissan has concealed this problem from its customers at the time of purchase or lease and thereafter,” the class action lawsuit states. Not only has this put consumers in danger, but it has also allowed Nissan to profit from the defect by selling replacement parts to Class Members.

The Nissan transmission defect class action lawsuit is brought on behalf of all U.S. consumers who purchased or leased any 2004 through 2006 Maxima, 2005 through 2006 Altima, or 2004 through 2007 Quest vehicle equipped with an automatic transmission. It is seeking class certification, damages, disgorgement of profits, and injunctive relief.

The case is Howard Teba v. Nissan North America, Inc. and Nissan Motor Company, Ltd., Case No. 12-cv-00332, U.S. District Court, Central District of California, Western Division.

UPDATE: This case was voluntarily dismissed by the plaintiff on June 29, 2012. Details behind the dismissal were not indicated in court documents.

    I have 2004 Nissan Maxima and it is 110000 miles on it and just yesterday my car transmission went dead. How can I get on this lawsuit?

    I have had my car since 2009 and have had 3 transmissions put in it so far and is now working on a fourth. I need answers because I should not have to deal with those issues. Buying that car was nothing but a waste of money and I don’t have it to waste. How do I get on a list or speak with someone about the issues I am continuously having out of my car?

    I have an 05 Nissan Maxima that is doing the same thing I was told it could cost anywhere between 2000 to $4,000 to replace the valve body. how can I get on this lawsuit

    2006 Nissan Maxima started jerking at 100,000 miles, starting to get worse and worse. Intense bucking when going to shift gears. Same problem as everyone else

    Have a 2005 with 44327 miles and the same problem with transmission.I try to join the law suit but cant, because I live in Puerto Rico and PR dont show up on the state dropdown list. We are US citizen but not a state.Does any one know how we can join this law suit action? We will appreciate your information.

    Mine is a Quest 2007 base model. I have a serious problem with its transmission. The whole vehicle jerks, while speeding up gear sometimes shifts and sometimes runs in second or third .Auto shift to fourth makes a jerk and noise. Its exactly 100,000 miles now. I consulted a mechanic and he estimated $2500/-.I am not sure what to do!!!!

    As stated previously, there is no more ability to be added to the lawsuit as it was voluntarily withdrawn by the plaintiff that initiated the case. The interested party probably got paid off/etc or their car was fixed to avoid this issue like the others.

    STOP WASTING YOUR TIME AND ENERGY ATTEMPTING TO BE ADDED TO A NON-EXISTANT LAWSUIT. INVEST YOUR EFFORTS IN CREATING A NEW LAWSUIT OR CONTINUED RESEARCH SO WE CAN BE RIGHTLY ENTITLED TO A REPLACEMENT FOR THIS DEFECTIVE TRANSMISSION. SHAME ON YOU NISSAN!!!

    This is sad to read. I own a 2006 Nissan Maxima and I just hit 100,000 miles. Things have slowly been acting up, but I keep getting them fixed. Now the automatic transmission is not going into the correct gear fast enough when I am driving so it forces the vehicle to buck. I am afraid I am going to try passing someone on the highway and the car isn’t going to shift quick enough and something is going to happen to my family and I. I need to know what are the next steps to having my transmission fixed at Nissan’s expense? Can someone please reply or posted what should I do before I spend all of my money or sell this car?

    I certainly wish I would have reviewed this e-mail thread before I spent over 3800 dollars for a transmission and motor on my 2004 nissan maxima. As described in all of the other messages, I have experienced the same problems with computer issues, jerking when changing gears and loud rattling noises. Can I please be added to Class Action Law Suite.
